Eminent Domain"'..biggest case was in Connecticut, with Kelo vs. New London wondering if this could be a back channel com
For those who may not know the history of this case. The city of New London went to court to enforce eminent domain for the Pfizer Company who wanted to build a facility along the Thames River, the thing that stood in the way of them being able to pursue this venture were pesky home owners who's families had been there for many generations. The shortened version is the city went to Supreme Court, and won their case. Pfizer in the end decided they were backing out of the deal. Leaving the carnage of homeowners on the losing end of nothing. Most shocking was this: Never before has the law sided on the side of the government to purchase/take private property on behalf of a private company.
Kelo v. City of New London
Citation. 545 U.S. 469, 125 S. Ct. 2655, 162 L. Ed. 2d 439, 60 ERC 1769 (2005)
Brief Fact Summary. In 2000, the city of New London approved a development plan that, in the words of the Supreme Court of Connecticut, was “projected to create in excess of 1,000 jobs, to increase tax and other revenues, and to revitalize an economically distressed city, including its downtown and waterfront areas.” The city purchased property and seeks to enforce eminent domain to acquire the remaining parcels from unwilling owners.
