Apparently AIS is only required for vessels over 300 tons. I know nothing about boats; so I can't say how bigish that is for private ocean-going craft. Billionaire-class yachts seem to be orders of magnitude larger. But if someone wants to sneak around in a smaller boat then they certainly could.
