Am I wrong in thinking this is the first time we have tried a war enemy in a criminal court under civil jurisprudence, and sentenced them to prison??
War (and terrorists, which are extra-national enemy combatants) exist outside the United states statutory and criminal legal system. That is why we keep enemy combatants at Gitmo, so they aren't on US soil ..where they would suddenly fall under our legal system and hell would open up to spill out lawyers wanting to 'defend' them.
How did we end up sending an enemy combatant to a criminal trial under our court system? for something that happened outside the US, by extra-nationals, as an act of war?
And what does this mean for The Plan?
