In court, KSM lawyer Nevin asks Dr. Mitchell about the emotion he's shown in court when talking about his decisions to do what he did.

Dr. Mitchell talks about the enormity of the 9/11 dead, his voice shaking, calls it genuine, says those who doubt it should 'kiss my ass.'

Nevin: You know people all over the Middle East have also died in gigantic numbers?

Prosecutor Groharing: Objection.

Defense lawyer Nevin: Bias.

Judge Cohen: Overruled.

Nevin resumes his description of how people in the Middle East may have similar emotional reactions to their enormous losses…

Mitchell, on KSM: 'He should've stayed home and taken care of those people… You're not going to shame me into forgiving that guy.'

Dr. Mitchell just said he doesn't believe his C.I.A. contract company provided the guards to Guantanamo's Camp 7 prison after KSM and the others were moved there from the black sites in September 2006.

So who were these guys?

Guantánamo Testimony Details Initial Handling of Prisoners Accused of Plotting 9/11

A former commander of the most secretive part of the prison compound told how the accused plotters of the Sept. 11 attacks were guarded by a secret force dressed like U.S. troops.

Intriguingly, Dr. Mitchell also testified that when the C.I.A. had a secret prison at Guantanamo (2003-2004) the guards would go to work in U.S. military uniforms and change into some other kind of outfits for their black site duties. (Camp Echo II)

On a question from Mr. Harrington, Dr. Mitchell confirmed that he is of the opinion that the five men in the 9/11 case should be summarily tried and executed.

He acknowledged that if the judge excludes some FBI statements as tainted by torture it will make that more difficult.

Prosecutor Jeffrey Groharing had tried to cut this off with an objection. Mr. Harrington said it goes to bias and the judge overruled the objection.

Dr. Mitchell also said that he sees the American attorneys representing KSM and the others as "Al Qaeda defense lawyers."

Court is done for the day but here's one leftover remark by Dr. Mitchell from Mr. Harrington's questioning…

"President Obama ended my association with the CIA the second day he was in office."
