Chuck Schumer (D-NY) hopefully asked presiding officer Chief Justice John Roberts Friday evening if he was aware of a precedent for him casting tie-breaking votes as the Senate prepared to cast more votes to table several Schumer resolutions on witnesses and evidence.

 

Schumer cited the 1868 Senate impeachment trial of President Andrew Johnson presided over by Chief Justice Salmon Chase in which he cast two tie-breaking votes.

 

Roberts was ready for the question and carefully read his reply:

 

I am, Mr. Leader. Uh, the one concerned a motion to adjourn, the other concerned a motion to close deliberations. Uh, I do not regard those isolated episodes a-hundred-and-fifty years ago as sufficient to support a general authority to break ties. If the members of this body, elected by the People and accountable to them, divide equally on a motion, the normal rule is that the motion fails. I think it would be inappropriate for me, an unelected official from a different branch of government, to assert the power to change that result so that the motion would succeed.

PHOENIX — A man believed to have been the leader of a group of Al-Qaeda terrorists in Al-Fallujah, Iraq was arrested yesterday in Phoenix, accused of murdering two Iraqi police officers.

 

The United States Department of Justice says Ali Yousif Ahmed Al-Nouri, 42, was arrested in the Phoenix area recently and efforts are being made to extradite him to the Republic of Iraq.

 

Al-Nouri is wanted to stand trial in Iraq for two charges of premeditated murder committed in 2006 in Al-Fallujah, according to a release.

 

According to the Government of Iraq, “Ahmed served as the leader of a group of Al-Qaeda terrorists in Al-Fallujah, Iraq, which planned operations targeting Iraqi police.”

 

Ahmed and other members of the Al-Qaeda group are accused of killing a first lieutenant and also an officer from the Fallujah Police Directorate in 2006.

 

According to the Department of Justice, “Ahmed’s arrest was executed by the FBI Phoenix Field Office, HSI Phoenix Field Office and the U.S. Marshals Service. The extradition case will be handled by the U.S. Attorney’s Office for the District of Arizona and the Criminal Division’s Office of International Affairs.”

PHOENIX (AP) — Federal authorities say they have arrested a Phoenix-area man suspected of killing two men while acting as a leader of al-Qaida in Iraq.

 

The Department of Justice said that 42-year-old Ali Yousif Ahmed Al-Nouri appeared before a magistrate judge on Friday for proceedings to extradite him to Iraq.

 

The department says the government there has charged Al-Nouri with two counts of murder in connection with a killing in 2006 in Fallujah.

 

They say that he and other members of al-Qaida shot and killed a lieutenant and an officer with the Fallujah Police Directorate in 2006.

 

A U.S. magistrate judge issued a warrant for him on Wednesday.

 

It’s unclear how long Al-Nouri had lived in the Arizona or what he did in the state. No further information was released.
