Jacinda Ardern to join Australian national cabinet meeting on Tuesday

 

New Zealand Prime Minister Jacinda Ardern will join Australia's national cabinet meeting on Tuesday to discuss COVID-19, Prime Minister Scott Morrison has announced.

 

The national cabinet meeting takes in the Prime Minister and all state and territory premiers and chief ministers.

 

Mr Morrison suggested last Thursday she phone in to the meeting, and following national cabinet's agreement on Friday, she was formally invited and has accepted.

 

They are expected to discuss a mooted "trans-tasman bubble" that would allow Kiwis and Australians to freely travel between countries.

 

They will also discuss the CovidSafe app, a version of which NZ is also adopting.

 

New Zealand's Foreign Minister Winston Peters has said he is very keen on the idea of the trans-tasman bubble and Health Director General Ashley Bloomfield said on Monday he was in constant contact with his Australian counterparts.

 

Mr Bloomfield said he had been providing advice to Ardern ahead of the call.

 

Mr Morrison also had a discussion with British Prime Minister Boris Johnson on Sunday night, with the two leaders discussing how each of their countries had dealt with the coronavirus and how they would ease restrictions and open up the economy.

 

They also discussed Australia's push for an independent review into the origins of the global pandemic.

International Production Orders Bill will give ASIO access to encrypted communications

 

The spy agency said the Bill would help it fulfil its function of protecting Australia from violent, clandestine, and deceptive efforts to harm Australians and undermine the nation's sovereignty.

 

The Australian Security Intelligence Organisation (ASIO) has shown its support for the Bill, paving the way for Australia to obtain a proposed bilateral agreement with the United States for implementing the US Clarifying Lawful Overseas Use of Data Act (CLOUD Act).

 

In a submission [PDF] to the Parliamentary Joint Committee on Intelligence and Security (PJCIS), ASIO said the Telecommunications Legislation Amendment (International Production Orders) Bill 2020 (IPO Bill) is a "key mechanism to enable ongoing and reliable access to a broad range of data and communications sourced from offshore providers".

 

The IPO Bill is intended to amend the Telecommunications (Interception and Access) Act 1979 (TIA Act) to create a framework for Australian agencies to gain access to stored telecommunications data from foreign designated communication providers in countries that have an agreement with Australia, and vice versa.

 

The Bill is a precondition for Australia to obtain a proposed bilateral agreement with the United States in order to implement the CLOUD Act. The CLOUD Act creates a legal framework regulating how law enforcement can access data across borders.

 

A bilateral CLOUD Act agreement would enable Australian law enforcement to serve domestic orders for communications data needed to combat serious crime directly on US-based companies, and vice versa.

 

Specifically, ASIO said passage of the Bill would allow it access to encrypted communications stored overseas.

 

"Australia has seen a steady shift to encrypted Internet Protocol (IP)-based communications over the past decade, with the majority of these services provided by offshore companies," it wrote. "This shift in communications practices has naturally been mirrored by the subjects of ASIO's investigations."

 

ASIO said as companies that provide encrypted IP communications services are mostly based offshore meaning they often fall outside the legal frameworks in Australia that authorise interception of communications or disclosure of telecommunications data such communications are therefore not accessible to ASIO or, when collected through warranted interception via onshore providers, are encrypted and unusable.

 

"The Bill seeks to enable access by agencies such as ASIO to data controlled by technology companies located offshore, where such access is for national security purposes. It will enable ongoing and reliable access to a broad range of data and communications sourced directly from offshore providers," it said.

 

"Legislation that supports ASIO's ability to fulfil its function to obtain, correlate, and evaluate intelligence relevant to security is essential."

 

ASIO said the Bill would provide it with a clear legal mechanism to seek access to data and communications, and that it would help ensure consistent and reliable access in support to investigations.

 

"By enabling ongoing and reliable access to data and communications sourced from offshore providers, where such access is for national security purposes, the Bill will assist us to fulfil our function of protecting Australia from violent, clandestine, and deceptive efforts to harm Australians and undermine Australia's sovereignty," it said.

Three NSW men arrested over alleged purchase of child-like sex dolls

 

Three men have been arrested as a result of coordinated operations conducted across NSW in two days, targeting purchasers of child-like sex dolls.

 

The men each face a potential 15 years jail if convicted of possessing one of the dolls, under a new Commonwealth offence introduced in September 2019 to combat child abuse-related offences.

 

A multi-agency investigative team comprising Australian Federal Police (AFP), Australian Border Force (ABF) and the New South Wales Police Force (NSWPF), was formed after ABF officers intercepted three separate importations of the dolls throughout March and April.

 

Financial intelligence from AUSTRAC’s (Australian Transaction Reports and Analysis Centre) Fintel Alliance, with support from PayPal Australia and NSWPF, was used to assist in identifying transactions involving the purchase of the dolls.

 

These detections were referred to the AFP Eastern Command’s Child Protection Operations team to lead the formation of joint investigative teams.

 

On Thursday (30 April), the investigative teams executed search warrants at two homes - one in the Grafton area on the mid-north coast, and one north of Sydney.

 

A 62-year-old Grafton region man was arrested at his home, accused of importing a child-like sex doll from China.

 

Police will allege in court they found two dolls dressed in children’s clothing, as well other children’s clothing items at the property.

 

The 62-year-old was refused bail and appeared in Lismore Local Court by video-link yesterday (Friday, 1 May) charged with:

 

  • Two counts of possession of a child-like sex doll, contrary to section 273A.1 of the Criminal Code Act 1995 (Cth)- penalty: 15 years imprisonment;

 

  • Six counts of possessing or controlling child abuse material obtained or accessed using a carriage service, contrary to section 474.22A of the Criminal Code Act 1995 (Cth)- penalty: 15 years imprisonment;

 

  • One count of import a prohibited tier 2 item, contrary to section 23BAB(5) of the Customs Act 1901 (Cth)- penalty: 10 years imprisonment.

 

In a second operation conducted Thursday, a 42-year-old Sydney man was also arrested at his Turramurra home, after investigators allegedly found a sex doll designed to look like a young child imported from Japan, and a second doll inside the property.

 

The man appeared before Parramatta Local Court Friday, 1 May charged with:

 

  • Possession of a child-like sex doll, contrary to section 273A.1 of the Criminal Code Act 1995 (Cth);

 

  • Import a prohibited tier 2 item, contrary to section 23BAB(5) of the Customs Act 1901 (Cth);

 

  • A state-based possession of cannabis offence.

 

A detailed forensic examination is being conducted of electronic devices seized from both the men’s homes.

 

Meanwhile, a third operation was conducted Friday morning (1 May) in the Grafton area. A 37-year-old man was arrested and charged with the Commonwealth offences of possession of a childlike doll, importing prohibited goods without approval, and possessing child abuse material.

 

He was scheduled to appear before Lismore Local Court Saturday, 1 May.

 

Police do not allege any connection between the three men.

 

AFP Assistant Commissioner Lesa Gale, Australian Centre to Counter Child Exploitation (ACCCE), said importing and possessing child-like sex dolls is illegal and any discovery of the abhorrent items, which objectify children, is concerning.

 

“These arrests highlight the work the AFP is doing with our partners to stamp out any form of child exploitation,” AC Gale said.

 

“These dolls sexualise children, they are not harmless and do not prevent people from offending in the future.

 

“Child-like sex dolls can desensitise people who use them to the physical, emotional and psychological harm caused by sexual abuse.

 

“Research by the Australian Institute of Criminology suggests that use of the dolls may lead to an escalation in child sex offences – from viewing online child abuse material to contact sexual offending.”

 

Australian Border Force Regional Commander for NSW Danielle Yannopoulos says child-like sex dolls are prohibited items and have no place in Australian society.

 

“The ABF is committed to detecting these dolls at the border and investigating and prosecuting those who seek to import this sickening material into our community,” Commander Yannopoulos said.

 

“Officers stopped 18 consignments containing child-like sex dolls and parts at the border in the first three months of 2020, highlighting the ABF’s zero tolerance approach to child exploitation material.”

Chinese government slams Australia over COVID-19 dossier coverage

 

The Chinese government has delivered a scathing response to reports in Australian media today, warning tensions could escalate.

 

The Chinese government has hit back at Australian media reports claiming it deliberately concealed evidence of the coronavirus outbreak, saying it could exacerbate tensions between the two countries.

 

Communist Party mouthpiece The Global Times said that western media outlets – “particularly those in Australia” – have “lost their self-proclaimed journalistic professionalism and independence”, and are now “hurting the profound friendship” between the two countries.

 

“Some Australian media and political elites have lost their independent judgment of the country's overall interests and have adopted a US-led approach to smearing China over COVID-19. They are hurting the profound friendship between the two peoples and the common interests that have long coalesced," the report said, quoting a Chinese professor.

 

It came after The Saturday Telegraph published a report on a 15-page dossier compiled by the Australian Secret Intelligence Service for “Five Eyes” partners the US, UK, New Zealand and Canada.

 

The report said China’s initial secrecy amounted to an “assault on international transparency”.

 

The dossier describes how Chinese authorities covered up the news of the virus “to the endangerment of other countries” by “disappearing” doctors who spoke out.

 

It claims “virus samples (were) ordered destroyed at genomics labs, wildlife market stalls bleached, the genome sequence not shared publicly, the Shanghai lab closed for ‘rectification’, academic articles subjected to prior review by the Ministry of Science and Technology and data on asymptomatic ‘silent carriers’ kept secret”.

 

It also accuses the Chinese government of destroying laboratory evidence and refusing to co-operate with international scientists working on a vaccine.

 

The report cites a "deadly denial of human-to-human transmission" and a delay in acknowledging the risk to the World Health Organisation, which saw millions in Wuhan free to travel and spread the deadly disease.

 

Australian intelligence officials say the P4 laboratory at the Wuhan Institute of Virology had been investigating deadly bat-derived coronaviruses.

 

But experts noted that, while the dossier was “significant”, it provided no new evidence to further the case against China.

 

The Australian Government and NATO officially say it’s likely the virus originated in a Wuhan wet market.

 

The Office of the Director of National Intelligence acting director Richard Grenell likewise said the virus was not created in a laboratory.

 

“The entire intelligence community has been consistently providing critical support to US policymakers and those responding to the COVID-19 virus, which originated in China,” he said.

 

“The intelligence community also concurs with the wide scientific consensus that the COVID-19 virus was not man-made or genetically modified.

 

“As we do in all crises, the community’s experts respond by surging resources and producing critical intelligence on issues vital to US national security.

 

“The intelligence community will continue to rigorously examine emerging information and intelligence to determine whether the outbreak began through contact with infected animals or if it was the result of an accident at a laboratory in Wuhan.”

Julian Assange's US extradition case delay by coronavirus complications, will take place in September

 

WikiLeaks founder Julian Assange's US extradition case will be moved to another British court after being delayed until September.

 

District judge Vanessa Baraitser has ordered the Australian's case, which had been set for May 18, be moved from Woolwich Crown Court to another court and to resume in September.

 

"It's going to take some negotiation to find a Crown Court that is open in September, in the current climate, and willing and available to take this hearing," judge Baraitser said on Monday in Westminster Magistrates' Court.

 

The new location, which might be outside London, and start date for the remaining three weeks of the hearing will be confirmed on Friday.

 

Judge Baraitser delayed the May 18 hearing last week over her concerns that Assange and lawyers wouldn't be able to attend court in person due to the coronavirus lockdown.

 

She suggested July or August, but both prosecution and defence lawyers were busy during those months. Both parties support the delay until September.

 

Assange's father John Shipton is delighted about the delay, saying it will allow family and supporters from Australia to attend.

 

He's also optimistic Assange might not be behind bars for the whole four months.

 

"I'm hoping there will be a very strong and firm bail application," he told AAP.

 

"It appears his lawyers held the power in today's hearing and got the hearing dates they wanted, so it's a good sign."

 

Lawyers didn't attend Monday's hearing due to the lockdown.

 

Six journalists and six members of the public were in the courtroom. Journalists dialling in were accidentally left on mute and could only hear holding music for the entire hearing.

 

Assange's representatives confirmed he was "too unwell" to appear via videolink.

 

Judge Baraitser scheduled a callover hearing on June 1 if the Australian was well enough to attend via videolink.

 

The 48-year-old faces 17 charges of violating the US Espionage Act and one of conspiring to commit computer intrusion.

 

He's accused of publishing thousands of secret US diplomatic and military files, some of which revealed alleged war crimes in Iraq and Afghanistan.

 

The charges carry a total of 175 years' imprisonment.
