Senate confirms Alabama Judge Andrew Brasher for federal appeals court post
A Montgomery federal court judge was elevated to a seat on a federal appeals court Tuesday after the U.S. Senate voted along party lines confirming Judge Andrew Brasher to the 11th U.S. Circuit Court of Appeals.
Brasher, who quickly rose up the ranks from Alabama’s solicitor general to a federal judgeship, was confirmed in a 52-43 vote in the Senate. His nomination faced criticism from the Alabama NAACP and other groups, who contended that he would be unfair to African Americans after he supported gutting key provisions of the Voting Rights Act of 1965.
Brasher, who was nominated by President Trump for the post in November, was rated qualified by the American Bar Association.
Sen. Richard Shelby, R-Ala., applauded his colleagues for confirming Brasher.
“I believe Judge Brasher has served with impartiality, integrity, and purpose as a district judge, and I am confident he will continue to do so in this new capacity,” the senator said in a statement. “I commend President Trump on his decision to nominate Judge Brasher to the Eleventh Circuit and know that his dedication to justice will contribute to the respected standards of our nation’s judicial system.”
Shelby’s Democratic counterpart, Sen. Doug Jones, voted against confirming Brasher.
“Sen. Jones did not support his nomination to the district court and has not seen any new information that would change his position," a Jones spokeswoman told AL.com. "That being said, Judge Brasher currently serves on the bench and Senator Jones wishes him well going forward.”
With Brasher’s confirmation to the 11th Circuit – which has jurisdiction over federal appeals cases in Alabama, Georgia and Florida –, Trump has appointed half of the active judges on the circuit, according to Carl Tobias, a professor at the University of Richmond School of Law and an expert on federal judicial nominees.
Alabama Attorney General Steve Marshall, who worked with Brasher for part of Brasher’s tenure as solicitor general, called the confirmation a “victory for the rule of law.”
“Judge Brasher’s deep record of public service, combined with his impeccable legal credentials, more than qualify him for a seat on the 11th Circuit Court of Appeals,” Marshall said in a statement. “I am especially proud of his contributions as solicitor general for the state of Alabama, where he successfully argued cases before the Alabama Supreme Court, the 11th Circuit Court of Appeals and the U.S. Supreme Court. Without a doubt, Judge Brasher will bring a renewed focus to upholding the law as he assumes his new position on the federal appeals court.”

Maria Bartiromo Raises Hell – Did China purposely create coronavirus ‘biological weapon’ to target USA?
During a conversation about the virus’s effects on trade and economy, Bartiromo asked White House trade adviser Peter Navarro on Monday about the idea that the Chinese government may have manufactured the deadly virus in a “weapons lab” to target the United States.
She pointed to the end of last year, when China decided to send its top trade negotiator to Washington to sign “phase one” of a trade deal with the U.S.
“They knew that coronavirus had happened back in December,” Bartiromo said. “They sent a delegation to the White House to shake everybody’s hand. They knew that they had this virus that had started with the ‘phase one.’ Then, they sent the largest delegation ever to Davos.”
“Do we know if this started in a research lab?” Bartiromo asked. “And how come they won’t allow the CDC in there to better understand how this started, because if they started this in a weapons lab, that’s evidence that they are developing or trying to develop weapons of mass destruction, biological weapons.”

ICE: SIX DAY-LONG RAID YIELDS 75 FOREIGN FUGITIVES FROM MORE THAN 20 COUNTRIES

DETROIT – An MS-13 gang member, in the country illegally and wanted in El Salvador for homicide, was arrested last week by U.S. Immigration and Customs Enforcement’s (ICE) Enforcement and Removal Operations (ERO) during ongoing enforcement efforts in Michigan and Ohio targeting at-large criminal aliens, illegal re-entrants and other immigration violators.
“ICE officers are first and foremost focused on removing criminal aliens from the community,” said Rebecca Adducci, field office director of ICE ERO in Michigan and Ohio. “I applaud the dedicated men and women of ICE and our partners who work tirelessly to keep our communities safe, often in the face of great personal danger.”
Recent arrests include:
-In Wyoming, Michigan, a 52-year-old citizen of Mexico, who has convictions for possession of cocaine, DUI, and operating while impaired.
-In Galloway, Ohio, an MS-13 gang member charged by Salvadoran authorities with organized terrorism (gang membership), aggravated homicide, creating danger to national security and public peace. He is the subject of an Interpol Red Notice.
-In Warren, Ohio, 41-year-old citizen of Serbia, who has convictions for carjacking and operating a vehicle under the influence.
-In Detroit, a 53-year-old citizen of Honduras who has convictions for operating with ability impaired and twice for operating under the influence of liquor – 2nd offense.
-In Sterling Heights, Michigan, a 55-year-old citizen of Iraq, who has convictions for larceny in a building, delivery of a cocaine, breaking and entering an automobile with damage, delivery and manufacturing ecstasy, delivery and manufacturing marijuana, possession of cocaine, and possession of analogues.
-The individuals arrested were nationals of Albania, Bosnia and Herzegovina, Brazil, Burkina Faso, Cambodia, Costa Rica, El Salvador, Guatemala, Guinea, Honduras, Iraq, Israel and the Occupied Territories, Jamaica, Lebanon, Mexico, Nigeria, Saudi Arabia, Serbia, Thailand, Trinidad and Tobago, and Tunisia.
From Feb. 1-7, ICE arrested 75 foreign nationals, 70 percent of whom had prior arrests and/or criminal convictions.
Convictions included: retail fraud, illegal entry, operating while ability impaired, operating under the influence, operating under the influence, operating intoxicated, operating a vehicle impaired, domestic violence, public intoxication, possession of marijuana, use of marijuana, larceny in a building, delivery of controlled substance, to wit: cocaine, breaking and entering an automobile with damage, drug charges, disorderly person, disorderly conduct, malicious destruction of property, stalking – personal protection order violation, impaired driving by controlled substance, driving with a, operating a vehicle while intoxicated endangering a person, physical control of vehicle while under the influence, sex offenders – failing to pay registration fee, criminal sexual conduct, minor in possession of alcohol, disturbing the peace, aggravated assault, assault and battery,, tampering with evidence, carjacking, corruption of a minor, among others.
