A CLEAR AND PRESENT DANGER

During both Crossfire Hurricane and during the impeachment proceedings, Democrats constantly and loudly proclaimed that corrupt political interference centered around Ukraine was an urgent threat to U.S. national security; that it represented a clear and present danger sufficient to justify maximal use of government branch powers for both investigation and enforcement, and declared it an emergency situation permitting minimal amounts of due process for the accused and broadly inclusive interpretation of criminal statutes in prosecution.

 

President Trump can’t just ignore these concerns, especially because millions of Americans share the same view, and it has put our country in a constant state of near-hysteria.

 

With his own acquittal behind him, and cleared of all collusion suspicion by the Mueller investigation, our president holds the unique position of being the only person in any of the three branches of government who has been thoroughly vetted.

 

The Constitution makes it the President’s duty to protect the national security interest and the law gives his office vast powers to use during times of urgent crisis.

 

Congress proudly stepped up to face the crisis with maximized use of power, but failed to solve the corruption issues by their own admission.

 

In the wake of that failure, and given an urgent national security threat, can the President let the American public see an executive branch any less fully committed?

 

The president can use his emergency powers and national security authority to lead the nation out of this crisis.

 

The argument for maximum effort has already been made — by both Democrats (and at least one ‘honorably bipartisan’ Republican): They informed us that this situation is too urgent and vital to national security that it can’t wait to be addressed at the naturally slow pace of normal government process.

WHAT CAN THE PRESIDENT DO?

 

The President can order a hand-picked team from DOJ and FBI to open and pursue a counterintelligence investigation. They can obtain FISA warrants, and utilize NSA databases to create a network map of connections starting from known foreign conspirators operating in Ukraine, Russia, and elsewhere.

 

The current investigation into Rudy Giuliani can be wrapped together into the broader investigation, and Rudy’s information can be either discovered as propaganda or entered into evidence.

 

Immediate arrests can be made using FARA violations and other laws. Previously negotiated immunities would be voided by discovery of new illegal action. Suspended investigations could be reactivated.

 

State department, CIA and military counterintelligence and counterterrorism can also play a role. Military rendition, indefinite detention, and even drone strikes can be legally utilized to end direct national security threats. Habeus corpus can even be suspended under current laws, and citizenship status can be revoked for certain crimes. Enhanced interrogations have been argued by previous administrations as a necessary tool to counter emergent threats.

 

Political office holders and members of the press who participated in illegal activities would not be immune, nor would the network and organizational assets they utilized to engage in illegal activity.

 

Whole corporations would risk losing everything under asset forfeiture laws unless they agree to cooperate.

 

National guard and other federal enforcement agents could be deployed to protect states citizens’ civil rights to free and fair elections, just as they did during desegregation.

 

Civilians suffering or at risk from media-induced psychosis could be quarantined or treated in their own homes, hospitals, or FEMA camps.

 

Obviously, the President would not likely need to exercise all these options.

CONSEQUENCES AND CONSIDERATIONS

 

There exists precedent for each and every one of these steps. Many of those likely to fall under the investigation and enforcement actions themselves voted for, justified, and utilized the same powers.

 

We all know that the communists, Alinskyites, colluders, and agents of foreign powers would not, and (wherever they hold power) have not hesitated to abuse these same government powers.

 

Now let them sit in an isolation cell 23 hours everyday. Let them lose their fortunes by seizure and sorely-outmatched defense from aggressive prosecution. Let them have their names besmirched and their support networks disrupted in the name of ‘obstruction’ and ‘witness tampering’. Let them wonder if due process will be afforded them, and wonder in their dark hours between interrogations what ‘actionable intelligence’ they might offer up.

 

The number of the most corrupt probably numbers less than a single ISIS army. Why should 300 million U.S. citizens lose our votes, and further billions worldwide suffer from loss of U.S. aid and stability (as the Impeachment House Managers argued is the case)?

 

Let them come crying for fairness! Let them become devout scholars of the sacred Constitution and Bill of Rights! Let them plead that government is too big and wields too much power!

 

If they want to call President Trump a ‘tyrant’, he should give them a small taste of tyranny.

 

At best we purge the monsters from our midst and hear their lamentations for the next decade as their cases wind through the many levels of bureaucracy they love so much.

 

At worst, shocked Americans will reject the use of outrageous powers government is destined to abuse and do something to curb them.

 

There will be outrage and more calls for impeachment no matter what. But watch the outcry die down when these current cheerleaders for authoritarian witness the righteous exercise of the one thing they respect above all else: RAW, NEARLY UNLIMITED POWER.

 

Either way, Trump will have pulled off the greatest political judo flip in history, and cut cleanly through the Gordian knot of corruption currently binding our nation in crisis.
