If it never went to trial, how can it be "double-jeopardy"? The concept of DJ is that you cannot be twice tried for the same crime (if once found innocent). However, there was no prior finding of innocence, just the prosecutorial judgment not to prosecute AT THAT TIME. That is an administrative decision, not an adjudication.
