No, not through Probate. Feds can seize their assets through the Court and they can still be alive. Look at BackPage. The Feds seized their houses, bank accounts, etc. No need to die or Probate.
Exactly. Must have trusts in place and/or will. Wealthy people do not use a will per se. They dump everything into trusts of all sorts.
