Apple agrees to $500 million settlement for throttling older iPhones

Apple has tentatively agreed to a $500 million settlement after admitting to slowing down older phones. The deal would provide small payouts for many iPhone owners in the US, plus greater compensation for named class members and attorneys. It covers people who bought any product in the iPhone 6 and 7 lineup — which Apple secretly throttled to conserve battery life.

As Bloomberg Law notes, the settlement was filed in a California court last Friday and is awaiting final court approval. The deal — which took months to negotiate — would resolve dozens of class action lawsuits that were filed between 2017 and 2018, then later consolidated into one complaint.

By default, Apple will offer $25 to any current or former owner of a covered iPhone. Named class members will receive $1,500 or $3,500, and around $90 million will go toward attorneys. The settlement has a minimum payout of $310 million, so the payment might increase if few people file claims. Conversely, if payments exceed the $500 million cap, each iPhone owner will receive less money.

The case stems from Apple’s “Batterygate” controversy. In 2017, iPhone users discovered that iOS artificially limited processor speeds as phone batteries aged. This was meant to stop real problems with performance, since it reduced stress on the battery and could prevent accidental shutdowns. But Apple didn’t reveal the feature’s existence, leading people to believe their phones were simply slowing down from age. In lawsuits, users claimed that they bought all-new devices to fix the problem — but if they’d known about this feature, they could have replaced the battery instead.

French and Italian authorities have already censured Apple for the throttling controversy, with France announcing a €25 million fine last month. The US Justice Department also announced an investigation in 2018. Apple also dropped the cost of battery replacements and offered partial refunds to some iPhone owners who paid for a new battery.

When a Solano County woman came down with a suspected viral infection and needed treatment, doctors chose to take her to one of the busiest hospitals in Sacramento, not realizing she would become the first person in the nation to be diagnosed with the novel coronavirus without a known cause.

The hospital, UC Davis Medical Center, has an emergency room that’s often filled with homeless patients, their immune systems battered from living in encampments along the capital city’s riverbanks and sidewalks.

The potential for an outbreak among that unsheltered population — both in Sacramento and across California — is beginning to concern some public health officials as the coronavirus spreads.

On Thursday, a student at UC Davis’ main campus, about 30 miles from the hospital, was isolated after exhibiting mild symptoms of the virus. On Friday, a second case of unknown origin was diagnosed in Santa Clara County. And on Saturday, a man died of the coronavirus in Washington state, the first fatality in the U.S.

“I was thinking about it when I was in the … shower [on Thursday] morning, literally,” said Peter Beilenson, director of health services for Sacramento County, where preparations for a potential local outbreak began almost immediately after the Solano County woman was diagnosed. “We’ve been checking on the schools and on the nursing homes and on healthcare facilities, etc., and so I was thinking, ‘What about the homeless?’”

Netanyahu's Likud Party Leading in Israeli Election - Exit Polls

On Monday, Israeli citizens headed to the polls in what was the third election in less than a year after no single party in April and September managed to win an outright majority in the Israeli Knesset or negotiate a coalition.

The right-wing Likud party is leading in the Israeli snap general election, according to exit polls published on Monday.

The party is set to win 37 mandates, while the opposition Blue and White party of Benny Gantz will gain 33 seats, according to the exit poll of Israel's Channel 12. The Right bloc is gaining 60 seats, the Left bloc - 54, and the Joint Arab List is winning 15 seats, respectively. Yisrael Beiteinu (Israel is Our Home) is coming in fourth with 6 seats.

Channel 13 has projected the Likud Party to win 37 seats and blue and white - 32, respectively. The exit poll of the Israeli Public Broadcasting Corporation shows that Likud has 36 mandates, while Blue and White has 33 seats.

The Israeli justice minister also noted that defections from the Blue and White were possible. The finals results are to be released tomorrow.

Meanwhile, Israeli Prime Minister Benjamin Netanyahu took to Twitter to comment on the exit polls tweeting "thanks" in Hebrew.

Defence Minister Naftali Bennett also announced the Likud Party "has won the election" and said [they] would advise the president to mandate Netanyahu to form the government.

The head of the Joint Arab List, Ayman Odeh, said that the projected number of mandates is an achievement for his party that would help them to "prevent Netanyahu from building the 61 bloc".

As of 8 pm local time, the voter turnout stood at 65.6 percent - the highest since the 1999 parliamentary election.

The most recent polls projected that Netanyahu was most likely to build a coalition with the Blue and White party.

Israel has been in a political deadlock since Netanyahu's party won the poll but fell short of obtaining the majority needed to form a government in April. In the second election held in September, the Likud Party also failed to secure a majority in the Knesset.

Coronavirus: the Contagion of Propaganda

"The virus is coming, the virus is coming."

Here I want to comment on the true contagion of propaganda.

The press is piling on, as it always does. A story, true or false–it doesn't matter–describes how basic items are disappearing from store shelves in a town like there's no tomorrow.

The STORY causes fear. So more products disappear from store shelves in more places. Now a NEW story with photos of empty shelves takes center stage. More fear. More panic buying. And so forth and so on. The build-out of propaganda.

The psychological equation is: if there is fear, then the virus must be dangerous. But this is actually like saying: if a man walking on a street at night believes a mugger is about to parachute out of the sky, the sky-mugger must be real.

The story the press should be featuring is: "our coverage of so-called panic is creating panic." RUN THAT PIECE.

"Today in Manhattan, six greed-head editors of major newspapers and television news outlets met to discuss how their coverage is causing more and more fear. They agreed they were collaborating to incur a desired reaction…"

"Hey, guess what?" five hundred thousand readers and viewers of mainstream news say immediately. "THEY'RE making us afraid." If only that could happen, we'd be living in a different world.

The press is also cross-cutting stories. This technique works well. In the middle of a piece about empty store shelves, we're suddenly treated to a statement from some public health official, who says, "Epidemic cases are coming to America. We can't stop them."

Now you have two themes; each one gives added strength to the other. But wait. There's more. In the SAME STORY, we read or hear about a man in Montana or Arizona who has been identified as a carrier of the virus. He's being sequestered in a hospital. It's a triple play. Three streams of nonsense pouring into one another.

We're not nearly finished yet, because…social media. Someone takes the above story and flashes it on Twitter. Comments stretch out. A Twitter reader with a YouTube account sits down and turns out a quick video and posts it. His twist is: this is the big one; doomsday; it's a planned attack using the coronavirus.

Comments below the video feature a brawl about whether the virus was made in a lab, leaked out of the lab, or was designed as a weapon. And if a weapon, who did it? The Americans? The Chinese?

YouTube demonetizes the video. This gives rise to several articles in the "alternative press."

Now, a scuzzy outlet uses the demonetized video to make a point: people shouldn't fly off the handle with conspiracy theories; instead they should listen to the medical authorities talking sense about the virus.

Of course, the medical authorities are blowing out tons of their own version of fear porn. They're the propaganda experts. They use "science" to make their claims.

There are what, 20 or 30 supposed cases of the supposed coronavirus in America, out of a population of 300 hundred million? As I've detailed, the diagnostic tests, on which "new cases" are based, are worthless. But no matter. Join the Club of Fear. Your friends are in the Club. You don't want to feel left out, do you? …

Members of the “right” and “alt-right” love to use terms such as “the establishment,” “Deep State,” “globalists,” etc., in describing freedom’s political enemies. And, yes, I often use those terms too. For the sake of brevity, I will refer to the above as simply “the ruling class.”

Seldom, however, do conservatives identify who actually comprises the ruling class. Typically when using those terms, conservatives are attacking Barack Obama, Hillary Clinton and liberal Democrats in general.

While it is doubtlessly true that many liberal Democrats are pawns of the ruling class, so are many conservative Republicans. The ruling class monopolizes the philosophies, priorities and policies of both major parties in Washington, D.C.

The ruling class has mastered the phony left-right paradigm to perfection. The entire political debate in America centers on the left-right paradigm. If you are a Republican, Democrats are the enemy; if you are a Democrat, Republicans are the enemy. The entire political world revolves around this notion.

It’s all a game, a façade, a hoax.

Here’s how it works: When the ruling class wants to focus on building a socialist Welfare state, dismantling traditional cultural and religious norms and enacting gun control, it puts liberal Democrats in power. And when it wants to focus on building the Warfare State and creating foreign enemies for the purpose of expanding the “war on terror” and a global surveillance state, it puts conservative Republicans in charge.

And when it comes to accommodating the international bankers (translated: creating and increasing a debt-based economy), both Republicans and Democrats happily play along. The only difference in the economic policies of conservatives and liberals in D.C. is that liberals want to tax and spend, while conservatives want to borrow and spend. But both groups want to SPEND. Neither party cares a tinker’s dam about sound money principles or fiscal responsibility. That’s why no matter who the president is (including Donald Trump) or which party controls Congress (including Republicans), America’s national debt and deficit spending continue to spiral upward.

This also explains why, no matter who the president is (including Donald Trump), the same miscreants wind up in the president’s cabinet and administration. Donald Trump’s administration looks like Barack Obama’s. Obama’s administration looked like G.W. Bush’s. Bush’s looked like Bill Clinton’s, ad infinitum, ad nauseam.

The president doesn’t pick his cabinet and administration officials; the ruling class picks them.

US Awards $180Mln Contract for 15 Miles of Border Wall

A $180 million contract calls for constructing a 15-miles-long of a physical barrier separating the state of Texas’ Rio Grande Valley from Mexico, the US Customs and Border Protection (CPB) said in a press release on Monday.

"This project will include a 30-foot tall steel bollard wall, all-weather roads, lighting, enforcement cameras, and other related technology to create a complete enforcement zone. Construction is anticipated to begin in 2020, pending availability of real estate, in locations where no barriers currently exist", the release said.

The CBP said in the release that the contract was awarded to Southwest Valley Constructors Co. for a total contract value, including options, of $179.5 million.

The project consists of four non-contiguous segments, which will connect to other new border wall segments, within Roma, Rio Grande City, the release added.

The Rio Grande Valley is the busiest border sector in the United States. Thus far in fiscal 2020, the sector accounted for about 25 percent of the illegal alien apprehensions and ranked first in seized cocaine, methamphetamine and marijuana along the southwest border, the release noted.

The majority of illegal activity takes place in areas where the valley has limited infrastructure, access, mobility, and technology, the release said.

Multinational medics, civilian first responders ‘save lives’ at exercise Cope North 2020

ANDERSEN AIR FORCE BASE, Guam (AFNS) –

When lives are on the line, there is no margin for error–and for a group of multinational medics and first responders, their razor-thin lifesaving operations were put to the test during a Cope North 2020 joint, mass casualty field training exercise on the islands of Rota and Guam, Feb. 20.

Together, the United States Air Force and Navy, Japan Air Self-Defense Force, and Royal Australian air force raced against the clock in a realistic exercise scenario to save 24 patients from a bus rollover. They worked alongside Guam’s Army National Guard and local police and emergency medical personnel during integrated medical, air and ground operations.

Amid the sounds of injured patients screaming, helicopters flying and police sirens blaring, the team persevered past extreme duress to accomplish their goal: keeping every patient alive.

“When providing care for critical patients, minutes can often make the difference between life and death,” said U.S. Air Force Maj. Brian Johnson, Cope North 2020 medical planner. “Due to the (patient transport) distance and time of day, a ground-patient transfer wouldn’t have resulted in a favorable outcome had it been a real-life scenario. However, thanks to the Guam Police Department and local authorities, the patients who weren’t flown were able to get to U.S. Naval Hospital Guam in an expedited and safe manner.”

Mass casualty scenario–the bus crash

The synergistic movement kicked off with screeching tires as a bus driver lost control while driving on the island of Rota. Gliding into traffic, a loud, piercing boom erupted as a rollover crash ensued, jarring glass debris and its passengers aboard.

After surviving the collision, the “battered and bloodied” patients were approached by local first responders and a RAAF physician who provided initial triage until higher echelon care was available.

Inter-island medical care

Once the patients were stabilized, they were transferred onto a U.S. C-130J Super Hercules and flown to Andersen AFB where patients and medical care teams awaited transport to either a UH-72 helicopter, ambulance bus or Humvee to the U.S. Naval Hospital Guam. A motorcade of emergency-response vehicles, accompanied by the ambiance of red and blue lights from the Guam Police Department, transported the “accident victims.”

The U.S. Navy Medicine Readiness and Training Command Guam, which recently co-located with navy medicine, was the ideal hospital to accept aeromedical evacuation patients as their final stop, said U.S. Navy Commander Elliot Ross, senior medical officer, NMRTC Guam emergency department.

“This exercise was a great opportunity for the naval hospital on many levels,” Ross said. “Drills like these help our team to hone our skills and with an all-hands-on-deck approach, we can confidently practice and perform our procedures when responding and managing large-scale medical emergencies.”

The hospital’s collective efforts included a critical care transport team, which conducted inter-facility patient movement at the hospital. They also boarded the Guam Army National Guard’s UH-72 helicopter and conducted patient movement from Andersen AFB to NMRTC Guam. An all-hands hospital staff recall was directed for exercise support while the hospital’s command center coordinated additional island medical resources, regional military resources and local military operations centers with the NMRTC’s new emergency management team.
