IF balloons were found on scene I'd say this was a murder.
NO intelligent person (and these were chess grand masters) would use a plastic bag to huff laughing gas if balloons were available!
The balloon acts as a safety system.
Use is as follows

fill the balloon with nitrous
-
inhale and exhale deeply a few times
-
exhale completely and then allow the balloon to fill your lungs
-
exhale back into the balloon
-
continue breathing into the balloon allowing the balloon to fill your lungs on the inhalation until desired effect is achieved
if you pass out you'll release the balloon and thus remove the source of nitrous oxide and you'll be exposed to ordinary atmosphere and will quickly regain conciousness.
