Wells Fargo board members resign after scathing House report

 

Wells Fargo announced Monday that two of its board members, including its chairwoman, Elizabeth A. Duke, have resigned, following a scathing House report found that the bank’s leaders were slow to address a series of consumer abuse scandals.

 

Duke and board member James Quigley were both featured in a more than 100-page report by the House Financial Services Committee that cited thousands of pages of documents, emails and internal notes to conclude the San Francisco-based bank had not properly addressed its problems.

 

Duke had served on the board since 2016 and was elected chair in January 2018, making her among the highest ranking women in banking. Quigley had been a board member since 2013 and is CEO emeritus at Deloitte, the consulting firm.

 

Charles H. Noski, the former chief financial officer of Bank of America, will become chair of the company’s board.

In 2017, Duke, then vice chair of Wells Fargo’s board, questioned why the Consumer Financial Protection Bureau (CFPB) was including her on communications about actions the bank needed to take, according to the report. “Why are you sending it to me, the board, rather than the department manager?” she asked, according to notes taken by a CFPB official that were cited in the report.

 

A CFPB official later said Duke’s response came as a “surprise,” given that board members “would not typically object to receiving communication from a regulator,” according to the report.

 

In another exchange, James Quigley, also a board member, resisted attending a meeting with one of the bank’s regulators because he was overseas on vacation. “I am currently scheduled to be in the Galápagos Islands on these dates,” he said in a 2019 email, according to the report. “The sense of urgency is surprising, are they politically trying to put an enforcement action in place in front of the hearing? ”

Rep. Maxine Waters (D-Calif.), chair of the committee, had called on Duke and Quigley to resign last week.

 

House committee chair calls on two Wells Fargo board members to resign

 

Duke and Quigley were scheduled to appear before Waters’ committee on Wednesday. Their resignations were effective on Sunday.

 

They said in a statement that their resignations would allow the bank’s new CEO, Charles Scharf, to “turn the page” and "avoid distraction that could impede the bank’s future progress.”

 

“Out of continued loyalty to Wells Fargo and ongoing commitment to serve our customers and employees, we recommended to our colleagues on the Board that we step down from our leadership roles,” the statement said.

 

Among the country’s largest and most profitable banks, Wells Fargo has struggled to overcome a fake-accounts scandal, which ballooned as the bank admitted to other consumer abuses, including mistakenly foreclosing on hundreds of clients and repossessing the cars of thousands of others.

Last month, the bank reached a $3 billion settlement with the Justice Department and the Securities and Exchange Commission, acknowledging that for more than a decade, thousands of employees falsified records, forged signatures and misused customers’ personal information to meet unrealistic sales goals, opening millions of accounts consumers didn’t want in the process.

The committee’s report threatens to deepen the bank’s problems. The report found that the bank repeatedly failed to live up to regulators demands that it repay consumers and weren’t aggressive about addressing its cultural problems, despite public promises.

 

Scharf, the new CEO, is scheduled to appear before the Financial Services Committee on Tuesday, a potential turning point in the bank’s efforts to repair its relationship with lawmakers and regulators.

Convicted rapist Harvey Weinstein has two cellmates on Rikers Island, where he took a bad fall this weekend and is “miserable,” his spokesman said.

 

The disgraced movie mogul is housed in the North Infirmary Command with two “older gentlemen,” his spokesman Juda Engelmayer said.

 

“He’s miserable but trying to be optimistic as best he can,” Engelmayer said. “He has had a lot of time to think about his life and be humbled, but he thinks it’s going to be a long, uphill battle from here.”

 

Weinstein, 67, was ordered held without bail following his Feb. 24 conviction for raping a hairstylist and forcibly performing oral sex on a former “Project Runway” production assistant.

 

“It’s a prison cell,” Engelmayer said. “It has a sink and toilet, all stainless steel and open.”

 

Adjusting to jail life has been especially difficult without the aid of his walker.

 

On Saturday night, Weinstein took a tumble after trying to walk on his own. “He fell on his head and thinks he has a concussion,” Engelmayer said. “His head has been pounding since yesterday.”

 

Weinstein has a wheelchair but finds it difficult to use, the spokesman said. Weinstein was transferred to Rikers Island on March 5 after spending nearly two weeks at Bellevue Hospital, where he underwent a heart procedure last Wednesday.

 

The “Shakespeare in Love” producer faces up to 29 years in prison when he’s sentenced March 11.

Bangladeshi National Pleads Guilty to Conspiracy to Bring Aliens to the United States

 

A Bangladeshi national formally residing in Tapachula, Mexico, pleaded guilty for his role in a scheme to smuggle aliens from Mexico into the United States.

 

Mohamad Milon Hossain, 39, admitted that from March 2017 to June 2019, he conspired to bring, and brought, Bangladeshi nationals to the United States at the Texas border in exchange for payment. Hossain operated out of Tapachula, Mexico, where he maintained a hotel that housed aliens on their way to the United States. Hossain provided plane tickets and other assistance for the aliens to travel from Tapachula to Monterrey, Mexico where co-conspirator Moktar Hossain assisted their illegal crossing into the United States.

 

U.S. District Judge Diana Saldana accepted the guilty plea. Sentencing has not been scheduled.

 

“Hossain’s brazen scheme to smuggle Bangladeshi aliens into the United States put our national security at risk,” said Assistant Attorney General Brian A. Benczkowski of the Justice Department’s Criminal Division. “This guilty plea underscores the Department’s commitment to working with our law enforcement partners here and abroad to disrupt the flow of illegal aliens into the United States and bring human smugglers to justice.”

 

“Border Security is national security,” said U.S. Attorney Ryan K. Patrick of the Southern District of Texas. “Our DHS law enforcement partners work on both sides of the border to make sure it is secure. The Southern District of Texas is on the front line of the fight against illegal immigration and we will continue to lead the nation in doing so.”

 

“This plea is a clear statement that defendants who smuggle illegal aliens across the United States border for profit will face consequences in a U.S. courtroom,” said Special Agent in Charge Shane Folden of U.S. Immigration and Customs Enforcement’s Homeland Security Investigations (HSI) San Antonio. “HSI remains committed in aggressively investigating and prosecuting members of transnational criminal organizations that exploit and endanger the people they smuggle into the United States. We will continue to work with our law enforcement partners both domestic and international to maintain the integrity of our border and the safety of our communities.”

 

HSI Laredo is investigating this case with assistance from the HSI Human Smuggling Unit, HSI Mexico City, HSI Houston, HSI Calexico, HSI Monterrey, U.S. Customs and Border Protection (CBP) Office of Field Operations, CBP Border Patrol and the U.S. Marshals Service. The investigation is being conducted under the Extraterritorial Criminal Travel Strike Force (ECT) program, a joint partnership between the Criminal Division and HSI. The ECT program focuses on human smuggling networks that may present particular national security or public safety risks, or present grave humanitarian concerns. ECT has dedicated investigative, intelligence and prosecutorial resources. ECT coordinates and receives assistance from other U.S. government agencies and foreign law enforcement authorities.

 

Trial Attorneys James Hepburn and Erin Cox of the Criminal Division’s Human Rights and Special Prosecutions Section are prosecuting the case with assistance from the U.S. Attorney’s Office for the Southern District of Texas.
