The full context of that comment was that we already do that. He said due process “later” but we already do that and it meets all constitutional requirements so long as it is done in as expeditious matter as possible. Judges routinely issue temporary protective orders without notice to the accused, with a time for the accused to appear and defend himself/herself. Routine.

That said, and nothing against the Judge (who had a good long life at 87, and was healthy to the end), I am so excited that Trump can replace him with a judge who respects the Constitution. The 9th circuit has repeatedly been overturned and is absolutely HUGE. Good time to split it, divide up those liberal judges and put some judges in that respect the Constitution. This is a big deal.

Good thought. I hadn’t considered that and have been astonished that Obama left so many vacancies. Hundreds. All he had to do was assign a committee to vet them, then fill them to seal his legacy. Wonder if part of any deals he made with Hillary was to leave her judge vacancies.
