If Habeas Corpus is suspended, that'd be a dead giveaway. Or, if all the civilian courts are closed; yeah. However, you can get around all that red tape by simply accusing all of them with conspiring with foreign enemies. If that's the case, you wouldn't have to suspend or close any courts.
