>Uh Oh POTUS gonna have to declare Martial Law

No.

All individuals, regardless of citizenship, who associate themselves with the military arm of the enemy and with its aid, guidance and direction enter this country bent on hostile acts are enemy belligerents within the meaning of the Hague Convention and the law of war.

The individuals need not be caught while engaged in the act of war or captured within the theatre of war. They need not be found carrying weapons. Nor must their acts be targeted at our military.

Under the Commander in Chief Clause, the President is authorized to detain all enemy combatants and unlawful belligerents, including U.S. citizens. Such unlawful combatants and belligerents are subject to trial and punishment by our military tribunals. The use of martial law and the suspension of courts is NOT required.

>Martial law can only exist when judicial law does not.

Irrelevant.

Martial Law is not required before detaining enemy combatants; nor is it required in order to conduct a military tribunal and sentence the enemy combatant.

>This paves the way for military tribunals wherever the courts are "closed". Probably in those cities where the NG is building hospitals.

Civil courts don't need to be closed. Martial Law does not need to be declared.

The use of martial law and the suspension of courts is not required.

>The Commander in Chief clause? Gonna need some sauce for that assertion of Fact. We live in a Constitutional Republic. We follow the law.

Read the law; or at least read all of the crumbs. It's in there.
