It is. Gravitation is quite a weak force.

Influence of the moon on EQs is very weak, and (even though shown in some cases) still being debated.

Earthquakes happen along faults. As you can see, except the CA EQ at 10.2km the 10km EQs are all Idaho-related, so I guess that's approx. the depth that fault system slipped.

In addition to that, exact depth determination is really hard to do, not rarely impossible. So errors in depth of 1, 2 or even more km (depending on event depth) are quite common.
