There are no officially called-up MIL troops visible to the public, all we see are the NG & MASH facilities. Troops are still on bases. Actual MIL in the streets of CONUS will be lawful because they are going after foreign nationals upon whom war has been declared and so are considered enemy combatants (so they are not fulfilling a LE function against American citizens) .
