The lawyerly answer is: it depends. Because it depends.

It depends on what kind of action is being contemplated, and who is bringing that action against whom. Are we talking about an action in tort? breach of contract? a public or administrative law violation? a constitutional action under state or federal constitutions? a federal or state crime?

Until these matters are clarified, it’s unclear which court has subject matter jurisdiction and who might appropriately bring the action. Of course, if it’s criminal violation being alleged, would this be brought by a public prosecutorial authority, or as a private prosecution?

Tarring and feathering is much easier to carry out.

Who cooked the models to back POTUS into the position of no real alternative but a shutdown? Who was giving the instructions?

Nothing about this cluster fuck looks “organic.” Even FatBoyBarr couldn’t put this down to a “perfect storm” of fuckups.

This looks like an “operation.” It should be investigated as an operation. And every fucking person connected with any aspect should be viewed as “under suspicion” unless and until the evidence suggests otherwise.

This is about National Security. It’s certainly not just another potential crime.

Fraudi doesn’t understand policy in the real world.

For Fraudi, policy is whatever his bosses tell him it is, from time to time.

Fraudi would, upon instruction, have an entire economy shut down if it were merely possible that people might die from WuFloo.

But Fraudi has never insisted on shutting down the US economy for annual ‘flu. Or indeed for PigFloo under Obongo.

Fraudi never told us before that we all needed to remain half a mile apart, wear hazmat suits to fuck, or completely forget ever going to a place of worship, playing ballgames, or going to a gig, for as long as we live.

Fraudi’s been in his current job for more than 35 years without finding it necessary to tell Americans to give up on normal human association and interaction.

So why now, Fraudi?

Policy is propaganda. That’s why.
