this is another complex constitutional legal matter that has no precedent
SCOTUS has muddied the waters as usual
to get recess appts. congress must have adjourned "sine die" which means "without day" ie no fixed date to readjourn
its a common term in legislative affairs and everyone knows what it means
state legislatures do this every year
i do not believe the congress has done this for decades though and for the exact reason POTUS stated
its fuckery no doubt
so article 3 was intended to allow the exective to contninue important business while congress was adjourned
they have blocked that
blame mcconnell he is responsible and has deliberately done this for 3 years now
maybe he is the first sleeper to be outed?
but for legal IMO POTUS should proceed to adjourn and appoint and let them sue
it will expose them and go to SCOTUS
all bets are off

it is intentional as if the suffering were too great the system would topple so ordinary people are allowed JUST enuf to keep them on the bubble of revolt or giving up
