State Supreme Court rules against inmates who wanted early release for COVID-19 threat

The Washington Supreme Court on Thursday narrowly rejected a lawsuit that would have forced the state Department of Corrections to release inmates in order to keep them safe from the coronavirus.
In a lawsuit that named Gov. Jay Inslee and Department of Corrections Secretary Steven Sinclair and filed by five current inmates, the high court, meeting remotely, said the plaintiffs had not shown to the court that the state was "failing to perform a mandatory, nondiscretionary duty in addressing the COVID-19 risk at the Department of Corrections facilities."
The ruling by the court came fairly quickly after the conclusion of legal arguments, which began Thursday morning.
In a written statement, the Washington Association of Sheriffs and Police Chiefs expressed support for the court's ruling.
"A sudden mass release would have increased the number of new crimes committed, creating public safety concerns. Washington has a case-by-case release system to reduce inmate populations in response to COVID-19 and it should be maintained in support of public safety," the group said. "The mass release requested by Petitioners was excessive, overreaching, and without a statutory basis. We are grateful the court agreed."
The state has ordered the released of nearly 1,000 nonviolent inmates who were due to be released soon.
