November 14, 1986: The National Childhood Vaccine Injury Act (NCVIA) of 1986 (42 U.S.C. §§ 300aa-1 to 300aa-34) was signed into law by United States President Ronald Reagan as part of a larger health bill. NCVIA’s purpose was to eliminate the potential financial liability of vaccine manufacturers due to vaccine injury claims in order to ensure a stable market supply of vaccines, and to provide cost-effective arbitration for vaccine injury claims. Under the NCVIA, the National Vaccine Injury Compensation Program (NVICP) was created to provide a federal no-fault system for compensating vaccine-related injuries or death by establishing a claim procedure involving the United States Court of Federal Claims and special masters. Pres. Reagan said he had approved the bill “with mixed feelings” because he had “serious reservations” about the vaccine compensation program.
This was a major coup for the pharmaceutical industry. As a result of this bill, pharmaceutical companies no longer have any liability for harm caused by their vaccines based on whether the vaccines caused harm in testing. To make sure that no harm was found, testing of vaccines has since been greatly reduced compared to previous testing protocols. While this assured that a pharmaceutical company could rush a vaccine to market to aide in an “emergency,” it has also meant that those who take the vaccines have now unwittingly become the test subjects.
One of the provisions of the NCVIA is that your health care providers who administer vaccines against diphtheria, tetanus, pertussis, polio, measles, mumps, rubella, hepatitis B, Haemophilus influenzae type b and varicella must provide a Vaccine Information Statement (VIS) to the vaccine recipient, their parent or legal guardian prior to each dose. But how often does this happen? And what about additional vaccines that have been created since then?
