"Who controls the NG?"

 

Depends on who calls them up. If their governor, then he controls them under Title 32 USC. However, if activated under Title 32, the governor has to fund their operation.

 

if the US government activates the Guard, then they fall under Title 10 USC, just as the Regular forces. Then, normal command relationships can be established between the components. This has already been worked out within both policy and joint doctrine. Of course, in this case, the feds pay for the Guard's operations.

 

Important distinction: If NG are operating under Title 32 (i.e., state status), posse comitatus does not apply. Posse comitatus applies only to forces operating under Title 10.
