before 1871 (or 1933, still researching)

a lawyer was one who knew the law somehow

an attorney had passed the BAR exam

either one could represent you in court.

ever since the New Deal (bankruptcy of whichever corporate USA that was, third or fourth) and the loss of a "Federal general common law" with the Erie RR case and HJR-192, something changed about the courts such that you can only be represented by a BAR attorney. or that's the myth and good luck outflanking it.

single cause of action and UCC and onwards from there. Lex Mercatoria.
