Nonsense.
SCOTUS rarely steps in before a case has gone through the courts and then its usually because a judge either overstepped his/her bounds, or misinterpreted a previous decision.
The plaintiffs in this case went direct to SCOTUS after PA Supreme Court denied the request to lift the order; the correct place to go was Federal Circuit court first, not SCOTUS.
Had PA Supreme Court ruled against them in the State case, then SCOTUS would have been the correct place, but this was a denial of a request to lift the order.
I get that speed was of the essence; but the plaintiffs made a mistake.
Remember, under the request for an emergency stay, the SCOTUS judge assigned to the circuit COULD have lifted it on his/her own. They did not. They referred it to the full court.
Oh, and the judge was Alito which tells you that this is about procedure, not about the merits.
