I would think it would be pretty obvious, pretty quick if we were about to lose, and that would have every III% up and ready, at least 90% of the citizen militia would be activated pretty damn fast.

POTUS isn't using Army, Navy, or Air Force directly, only their equipment.
NG and USMC are still under DoD control, but can be deployed in the US as a police force during Martial Law, bypassing the Posse Comitatus Act by using 18 U.S. Code § 1385 - Use of Army and Air Force as posse comitatus.
According to that:
Whoever, EXCEPT in cases and under circumstances expressly authorized by the Constitution or Act of Congress, willfully uses any part of the Army or the Air Force as a posse comitatus or otherwise to execute the laws shall be fined under this title or imprisoned not more than two years, or both.
So from what I'm reading re, thy can b used as police force under certain circumstances.

Either way, war has to be declared prior to engaging military units.
