Three gym owners have filed a lawsuit with the Washington Supreme Court Thursday to rescind Governor Jay Inslee’s ‘Stay Home, Stay Healthy” order.
One of the gym owners was sued by Attorney General Bob Ferguson on Tuesday after he defied the Governor’s order by opening his gym for eight days.
The suit claims the Governor overstepped his constitution authority by “suspending the liberty interests” the gym owners and “has abolished the constitutional state of Washington, and has erected in its place an unacceptable tyranny in violation of his oath of Office…"
But timing is critical in the case as the arguments could become mute as the state moves toward reopening, possibly statewide by mid-July.
The Supreme Court typically operates on its own time frame with no guarantees hear arguments in a case or even take it up. Pidgeon believe they will and soon.
“If they accept the writ then we will be asking for an emergency hearing on the merits to see if we can get to court to promptly consider what is happening."
