I had read it, and got 2 things out of it. 1) is the one you mentioned and 2) was - new laws and regs to come from the FCC, FTC, Attorney General, etc.

 

1) is potentially BIG. Because Facebook Twitter Youtube are all censors now, censors of conservative content, but it really doesn't matter what they're censoring, except for the fact that it's content outside of their "allowed to censor" box, they're now PUBLISHERS.

 

What is HUGELY important is that it can now be said that Facebook Twitter and Youtube are the ones who are saying the things that all the people are typing.

 

This is HUGELY important in the context of DEFAMATION and also, maybe, in the context of Tortious Interference with Contract and Tortious Interference with Business Relationships.

 

There is now a DEEP DEEP Pockets defendant in any defamation case. Look at the jury verdict in Oberlin vs Gibsons. The fact pattern there was a bunch of leftist kids at Oberlin, and the professors and the administrators starting calling a bakery (Gibsons) racist because the bakery stopped a black shoplifter. I don't know to what extent Facebook or Twitter or Youtube had anything to do with the defamation and other torts in this case. But the college lost to this small bakery, and Gibsons won something like $30 Million. The Gibsons got that huge chunk of change because Oberlin has deep pockets.

 

These days, Facebook Twitter and Youtube are being used to defame a whole lot. Disgruntled people without deep pockets are attacking and really doing damage to businesses, and they're using Facebook, Twitter, Youtube to do it. Now that they're said to be publishers, it's Facebook Twitter and Youtube who are said to be defaming.

 

They used to have an excuse "we don't police content" or "we don't police content outside of things like child porn or animal crushing videos, the things the government told us we should be deleting or could be deleting" but when they start deleting for reasons outside the gov rules, that's the line that makes them a publisher, repsonsible for everything that everybody writes on facebook twitter and youtube.

 

I would think that juries would LOVE to stick it to Facebook Twitter and Youtube.

 

There should be TV ads any time now.
