Depends on what State you're in. Based on state law. Some states have castle doctrine, some states don't. But it can VERY easily be a crime even to defend yourself. Most of the time only proportionate force is allowed. Read up on your state self defense laws.

There has to be conditions to invoke the Insurrection Act whereas replacing a failed and corrupt political establishment with a new government more involves the staffing of the government and some legal changes that would be passed through legislation.

 

If there is domestic violence so much so that the States cannot enforce the law, the President can invoke the Insurrection Act but is checked by the Congress and they obviously would sue.

Whenever the President considers that unlawful obstructions, combinations, or assemblages, or rebellion against the authority of the United States, make it impracticable to enforce the laws of the United States in any State or Territory by the ordinary course of judicial proceedings, he may call into Federal service such of the militia of any State, and use such of the armed forces, as he considers necessary to enforce those laws or to suppress the rebellion.

รŸ 333. Major public emergencies; Iinterference with State and Federal law

 

(a) USE OF ARMED FORCES IN MAJOR PUBLIC EMERGENCIES.

 

(1) The President , by using the militia ormay employ the armed forces , or both, or by any other means, shall take such measures as he considers necessary to, including the National Guard in Federal service, toโ€“

 

(A) restore public order and enforce the laws of the United States when, as a result of a natural disaster, epidemic, or other serious public health emergency, terrorist attack or incident, or other condition in any State or possession of the United States, the President determines thatโ€“

 

(i) domestic violence has occurred to such an extent that the constituted authorities of the State or possession are incapable of maintaining public order; and

 

(ii) such violence results in a condition described in paragraph (2); or

 

(B) suppress, in a State, any insurrection, domestic violence, unlawful combination, or conspiracy if itโ€“ such insurrection, violation, combination, or conspiracy results in a condition described in paragraph (2).

 

(2) A condition described in this paragraph is a condition thatโ€“

 

(1) (A) so hinders the execution of the laws of a State or possession, as applicable, and of the United States within that State or possession, that any part or class of its people is deprived of a right, privilege, immunity, or protection named in the Constitution and secured by law, and the constituted authorities of that State or possession are unable, fail, or refuse to protect that right, privilege, or immunity, or to give that protection; or

 

(2)(B) opposes or obstructs the execution of the laws of the United States or impedes the course of justice under those laws.

 

(3) In any situation covered by clause (1) paragraph (1)(B), the State shall be considered to have denied the equal protection of the laws secured by the Constitution.

During an epidemic, serious public health emergency or terrorist attack involving domestic violence threatening public order, POTUS has discretion to call forth the armed forces or national guard in federal service to suppress the violence/conspiracy or insurrection.

 

The only reason I could suggest is optics. It has to be bad enough domestic violence that seriously threatens public order such that State law cannot be enforced.

 

Some cities have reached that. But it would also help if the governors requested it. They will play into this by accusing him of a dictatorial takeover confirming the bullshit narrative they have fed the last 3 years of Trump being an authoritarian takeover.

 

That's a threat to the rule of law even more. So at what point is it bad enough? It has to be a significant threat to public order. I'm thinking if it continues at its current pace it will absolutely be so. But not every state.

 

They will sue over it and if the conditions aren't bad enough, POTUS won't have the power to do it.
