lemme see if I got the jizz of what your sayin

cell phones are client side apparatus with open ports and a set protocol to server side software. The server can be updated at any time to handle the communications protocol any way the admin sets it.

This means that the cell phone is simple a remote operating device with 2-way communication back to the server that will send whatever information is requested, so long as the remote device contains the software for use, however there is scripting in the protocol that restricts the remote device (cell phone) from accessing the server.

That sound about right?

What's to stop someone from recording the communication protocol and writing that to an identical card minus the spyware?

Or is that something that would require a semiconductor manufacturer to undertake?
