Once you are taken into custody, it is the responsibility of the police to ensure your well-being. You are under their care. Imagine if a person had a broken neck and a cop was released from liability because "well, there neck was broken so it's not like he had to really twist his head that much."

It might help in a civil proceeding, but as far as criminal negligence, won't matter. The cops actions were directly related to GF's death. The question is, did he act with malicious intent and was the force unreasonable?

Seems easy enough to answer, but it never really is.
