Mayor Jenny Durkan and City Attorney Pete Holmes Issue Statements on President Trump’s Illegal Threat To Deploy Military Forces in U.S. Cities and States

City Attorney Holmes issued the following statement:

“POTUS has lost his mind. He just threatened to deploy active military forces in American cities in plain, criminal violation of the Posse Comitatus Act.

“The Posse Comitatus Act states that, ‘Whoever, except in cases and under circumstances expressly authorized by the Constitution or Act of Congress, willfully uses any part of the Army or the Air Force as a posse comitatus or otherwise to execute the laws shall be fined under this title or imprisoned not more than two years, or both.’ 18 U.S.C. § 1385.

“Even if this wasn’t blatantly illegal, does Trump actually want the Nation to burn? Our City will fight any steps to use the military against the American public.”

Presidents have leeway to use military for domestic purposes

Legal experts say the president does indeed have the authority under the Insurrection Act of 1807 to dispatch the military in states that are unable to put down an insurrection or are defying federal law.

Stephen Vladeck, a national security and constitutional law expert at the University of Texas at Austin, said on Twitter that the federal government does not necessarily need a state request before using troops for domestic law enforcement, and that the Insurrection Act is open-ended in letting the president decide when circumstances merited its use.

This is dangerous.

"I don't want to hear is for our constituents to be told to be civil, not to be reactionary, to be told looting doesn't solve anything."

I want to acknowledge that much of the violence and destruction, both here in Seattle and across the country, has been instigated and perpetuated by white men.
