1) A National Guardsman drives his/her motorcycle so as to report to duty in Washington D.C., but does not wear a motorcycle helmet, and said Guardsman is hit by a motorist. Even though the other motorist is at fault, the Guardsman is considered to be criminally negligent…because D.C. takes a tough stance on helmet use in order to prevent head injuries

2) A National Guardsman is ordered to perform duties in Washington D.C. and said duty assignment involves a high risk of incurring a head injury, but the Guardsman is prohibited from wearing a helmet?
