Man shot by police is charged with felonies

A 21-year-old man wounded by police gun fire in Minneapolis after allegedly trying to take an officer's gun has been charged with two felonies.

 

Ira L. Toles, of Minneapolis, was charged with two counts of obstruction of the legal process or arrest.

 

According to the criminal complaint filed Tuesday in Hennepin County District Court: Officer Derek Chauvin and his partner arrived at the scene of a domestic assault call early Saturday in the 1800 block of Columbus Avenue S. and had to force their way into the apartment.

 

Toles retreated to a bathroom and refused to come out. The victim told the officers that Toles might have a gun and could flee through a window. Chauvin's partner went outside in case Toles tried to escape.

 

Chauvin forced his way into the bathroom and, at gunpoint, ordered Toles to the floor. Toles refused. Chauvin then tried to physically subdue Toles, who was flailing his arms as he charged the officer. During the altercation, Toles forced Chauvin into a corner and tried to take the officer's pistol. Chauvin fired twice, wounding Toles in the abdomen.

 

Even after being shot, Toles continued to struggle with officers as they tried to handcuff him. He was arrested and was in custody in lieu of $20,000 bail.

Minneapolis police officer involved in weekend shooting ID’d

The Minneapolis police officer who shot a man during a domestic assault call Saturday has been identified.

 

Officer Derek Chauvin, a seven-year veteran, shot and wounded Ira Latrell Toles at a south-side apartment early Saturday.

 

According to police:

 

Just before 2 a.m., 911 dispatchers received a call from a residence at 1828 Columbus Ave. S. According to police, the 911 call remained open, and an operator could hear a woman yelling for someone to stop hitting her.

 

Chauvin and another officer who responded had to force their way into the apartment.

 

Toles ran from the officers as soon as they got inside, but they caught and tried to subdue him, according to police. In the struggle, Toles grabbed at one of the officer’s guns. Chauvin fired at Toles and hit him in the torso.

 

Toles was taken to Hennepin County Medical Center.

 

The officers are on paid administrative leave pending an investigation of the shooting, as is standard Minneapolis police department policy.

 

Chauvin started the Minneapolis Police Academy in October 2001. He has worked in the first, third, fourth precincts and the water works security detail. Earlier this year, he was awarded a department medal of valor for his response in an incident involving a man armed with a gun.

Police: Officers Involved In Shooting To Return To Duty

MINNEAPOLIS (WCCO) – Minneapolis police announced Friday that the officers involved in the Little Earth residential community shooting, which left one man with a bullet wound in his torso last Monday, have been authorized to return to duty.

 

After reviewing the investigation, Minneapolis Police Chief Timothy Dolan said the officers involved in the incident acted “appropriately and courageously.”

 

The shooting occurred near the Little Earth residential community, located on the 2400 block of Ogema Place, just before 11:15 p.m. Officers Terry Nutter, Steve Herron, Derek Chauvin, Brandon Brugger and Gwen Gunter responded to the shooting and saw the suspect – 23-year-old Leroy Martinez – running from the scene with a pistol, police said.

 

The officers took chase, and after repeatedly telling Martinez to drop the gun, an officer shot him in the torso.

 

Martinez is an Alaskan Native American who was living with relatives nearby. Investigators believe Martinez may have been targeting a fellow resident when the initial shots were fired.

 

He was charged Tuesday with felony second-degree assault by the Hennepin County Attorney’s Office. He faces up to seven years in prison and up to $14,000 in fines if convicted.

 

He was treated for the bullet wound at the Hennepin County Medical Center.
