They did tell him. He failed numerous sobriety tests, the last was the breathalyzer. The officer told him he was under arrest and got one cuff on when the perp flipped out on them and attacked them.

I did not see what the number was but he was over the legal limit.
Yes, he should have been arrested. He was drunk driving.

He does not live in that city. He had to be told what city he was even in 3 times- he didn't even know where he was.
He kept changing his story of what and how much he drank.
He could not explain how his car got from a parking place to the drive through line.
He did not remember passing out in the car, or being awakened by the initial police officer - twice.
He had been drunk driving.
Police have no duty to "let someone go" they have a duty to enforce the law.
He resisted arrest - crime.
He assaulted police - crime.
He stole the officer's taser - crime.
He shot the officer with the taser - crime.
He is the one who is responsible for his own choices (drunk driving, resist arrest, assault, etc) and no one else.
He does not somehow 'get a pass' for any reason.
He broke the law and was going to be arrested and rightly so.
He alone is responsible for what happened to him.
