We have no idea what led up to the pursuit of the individual in blue . However; leaving the area without having committed a crime grants the fleeing party protection rights so as not be detained or have undue force of restraint placed upon him.

More video will place a better perspective on this sad event.

Open carry is legal in NM but it appears(although we can't see for sure due to the vid quality ) he may have had it in a concealed carry mode. As I said, more vid will put this in better perspective. NM is a shall issue state for CCP if requirements are met.

Poor choices indeed..the worse he might of had is a misdemeanor assuming no other record had he not assaulted 2 officers then run.
