Jerry Nadler subpoenas Roger Stone prosecutor to testify about 'politicization' at Justice Department

 

The House Judiciary Committee said two top Justice Department officials, including a prosecutor from the Roger Stone case, will testify about the "unprecedented politicization" of the agency under President Trump and Attorney General William Barr. The move, announced Tuesday morning by Chairman Jerry Nadler, a New York Democrat, could lead to a clash with the Justice Department over what Aaron Zelinsky and John Elias are allowed to discuss. Nadler “issued two subpoenas for testimony from two Department of Justice whistleblowers," and the two DOJ officials are "prepared to describe the unprecedented politicization” of the Justice Department, according to a press release from the panel. The hearing is set for next Wednesday, June 24. The Justice Department declined the Washington Examiner’s request for comment.

 

Zelinsky, a former member of special counsel Robert Mueller’s Russia investigation and a special assistant U.S. attorney in Washington working on the case against longtime Trump associate Roger Stone, withdrew from the case in February along with three other prosecutors following the Justice Department’s decision to walk back its sentencing recommendation of seven to nine years in prison. Zelinsky now works for the U.S. attorney’s office in Maryland. Elias was the acting chief of staff in the Justice Department's Antitrust Division and is now a prosecutor who focuses on criminal antitrust cases.

 

Nadler criticized Barr in his Tuesday press release. “Again and again, Attorney General Barr has demonstrated that he will cater to President Trump’s private political interests at the expense of the American people and the rule of law. He has abruptly reversed course on prosecutions against the president’s allies and friends,” Nadler said. “The committee welcomes the testimony of current and former department officials who will speak to the lasting damage the president and the attorney general have inflicted on the Department of Justice.” In February, after the Justice Department recommended a prison sentence of up to nine years for Stone, Trump tweeted that he “cannot allow this miscarriage of justice!” The Justice Department then reversed itself, and the four line prosecutors withdrew. The department said its decision to reverse course was made before Barr was aware of Trump’s position, and Trump denied placing any pressure on the agency. The Justice Department walked back the “unduly high” sentence recommendation, suggesting three to four years instead but ultimately leaving it up to the judge.

 

Barr publicly griped about Trump's commentary on the case after the president congratulated his attorney general for "taking charge" of a case he described as being out of control. “I have a problem with some of the tweets,” the attorney general said, noting that Trump's posts about DOJ business made it "impossible" to do his job. “The Stone case was prosecuted while I was attorney general — and I supported it,” Barr said. “I thought that was a righteous prosecution. And I was happy that he was convicted.” “I think it’s time to stop the tweeting about Department of Justice criminal cases,” Barr said. “I’m not going to be bullied or influenced by anybody … whether it’s Congress, a newspaper editorial board, or the president.”
