If the mask was so necessary by recommendation of the House Attending Physcian, the requirement to wear a mask on the floor and in committee should have been included in the House Rules amendment, H. Resolution 965.

 

Per H.Res. 965, the "neccesity" to conduct proxy voting was due to health concerns of the Attending Physcian. The Rules amendment was prepared in May and [questionably] passed on May 15. Were facial masks not known of in May or were not considered effective that they were not incorporated into the resolution?

 

In the meantime, the House has repeatedly violated the existing House Rules and H.Res. 965.

Electronic card votes by proxy are not recordeded in the Congressional Record as voted by proxy while voice votes are recorded by proxy.

Per H.Res. 965, if a member votes their proxy authorization is revoked; if the electronic vote roll does not indicate a proxy vote, then all further proxy votes should be invalid.

H.Res. 965 states proxy votes are to be cast per the "exact instructions" of the member. Numerous Floor voice votes have proxy votes cast as "House Resolution" rather than "House Bill;" technically the proxy vote announced is for legislation non-existant legislation and inproperly recorded.

Also, some members casting proxy votes state H.R. 965 as the proxy authority which is incorrect as Rules were amended by resolution and not a bill and likely not the "exact instructions."

 

As the House repeatedly failed to follow the House Rules and amendment of H.Res. 965, they are in violation of the US Constitution and priior Supreme Court rulings that the may conduct business in accordance with their Rules.
