from watching the bodycam footage here are observations to Paul Howard's summary
Paul Howard has a slide show labeled:
Important Considerations:
-
Mr. Brooks calm, cordial and cooperative nature.
his calm and coperative nature was due to the fact he knew he was in violation of parole. he turned into mr smooth good guy hoping he didnt blow over .08
-
even though Mr. Brooks was slightly impared his demeanor was almost jovial
he is jovial because normally he is being treated as a convict who beats his kids, DUI is a cakewalk, career criminal. he does twatter shows on criminal reform, he is a community activist…that beats his kids so bad he gets 7 years
-
followed every instruction and question, some of them repeatedly for 41 minutes and 17 seconds.
he didn't follow any order the first time. everything was repeated 3 times. it took 1 minute for him to answer if he could take the sobriety test in the shoes he had on
-
Mr Brooks was never informed immediately that they are under arrest for driving under the influence, which is APD policy.
Roff told Brooks he was impared and under arrest when he grabbed his arm
-
Suddenly grabbed from the rear by Officer Roff, who made an attempt to physically restrain him, after the 41 min 17 sec discussion.
this is a lie. he walked over to him and let him know he failed the sobr test.
More Important Considerations
(Mr. Brooks was not a threat)
-
Mr. Brooks was peacefully sleeping in his car.
in a wedy's drivethru. the manager tried waking him up. he didnt wake. they called 911
-
Awakened, cooperatively and calmly moved his car.
The first time the other cop woke him up he fell back asleep. The cop returned to the car laughing. Asked Brooks if he was ok, then let him drive to the parking spot to the side. When Roff showed up wake-up cop states "he was sleeping in the drive thru, i woke him up twice, and he JUMPED THE CURB when parking to the side"
-
Mr. Brooks said he did not have a weapon.
-
Mr. Brooks gave his drivers license to the officer.
Brooks could not find his license. Wake up cop asks him to look for it. When Brooks finds it he gets out of his car. BIG NO NO. Gives cop his license, and the cop has to ask him 7 times to go back to his car, says repeatedly, "you are meking me keep asking you to go back to your car".
-
He consented to a pat down which subsequently yielded no weapon.
before he failed the breathalizer.
-
Never displayed any aggressive behavior.
mr good guy, used to system, thinks he is getting off, not drunk. Does not want to get violated
-
41 min and 17 sec
if you watch the bodycam footage is any of this true
Paul Howard is sweating like a waterfall spewing this nonsence.
Paul Howard overcharged this case bigtime. he wants the headlines now. how can any of the 11 charges hold up???
