Fired NY prosecutor was given Biden-Ukraine allegations in 2018 but didn’t follow up, emails show

 

Ukraine prosecutors didn't want the political spectacle that became impeachment and simply sought to turn over evidence about Joe Biden and election interference to U.S. prosecutors, memos show.

 

Could the impeachment scandal have been prevented if the now-fired U.S. Attorney Geoffrey Berman had followed up on Ukrainian allegations about Joe Biden and his family in 2018? That’s the tantalizing question raised by emails from fall 2018 between an American lawyer and the chief federal prosecutor in Manhattan that were obtained by Just the News. The memos show that well before Ukrainian prosecutors reached out to Rudy Giuliani, President Trump’s lawyer, in 2019 to talk about the Bidens and alleged 2016 election interference they first approached Berman’s office in New York in October 2018 via another American lawyer. The memos show Little Rock, Ark., lawyer Bud Cummins, a former U.S. attorney himself, reached out at least five times in October 2018 to Berman seeking to arrange a meeting with then-Ukrainian Prosecutor General Yuriy Lutsenko. Lutsenko, who emerged as a key figure in the impeachment scandal, wanted to confidentially share with federal prosecutors in New York evidence he claimed to possess that raised concerns about the Bidens’ behavior as well as alleged wrongdoing in the Paul Manafort corruption case. “Prosecutor General Yuriy Lutsenko is offering to come to U.S. meet with high-level law enforcement to share the fruits of investigations within Ukraine which have produced evidence of two basic alleged crimes,” Cummins wrote Berman on Oct. 4, 2018, one day after the two had talked on the phone about the allegations.

 

The allegations included that Joe Biden had “exercised influence to protect Burisma Holdings” after his son Hunter and his son’s business partner Devon Archer had joined the Ukrainian gas company’s board of directors and “substantial sums of money were paid to them,” Cummins wrote. At the time Hunter Biden and Archer joined Burisma in 2014, the company was under criminal investigation in both England and Ukraine for alleged corruption. The British case was dropped in 2015, and the Ukraine cases were eventually settled in the final days of the Obama administration. Joe Biden boasted during a 2018 public appearance that he forced the firing on Lutsenko's predecessor, Viktor Shokin, back in 2016 by threatening to withhold $1 billion in U.S. aid to Ukraine. At the time, Shokin was leading the investigation into Burisma. Biden denies the investigation factored into his decision. Biden’s and Archer’s firm received more than $3 million in payments from Burisma between 2014 and 2016, bank records obtained by the FBI show. Records recently released by the State Department also show Hunter Biden and Archer had contacts in 2015 and 2016 with senior State officials, including Secretary of State John Kerry and Deputy Secretary of State Tony Blinken.

 

In addition, Burisma’s U.S. representatives were lobbying the State Department in Washington and the U.S. embassy in Kiev seeking to make the corruption allegations go away, the State memos released under FOIA show. “The allegation by Prosecutor General Lutsenko et al is that the US ambassador, Marie L. Yovanovitch, Biden and Kerry made conclusions about who were the good guys and the bad guys in local government. They believe Biden and Kerry were influenced by payments to Hunter Biden and Devon Archer to influence certain decisions, particularly those benefitting Burisma,” Cummins wrote, relaying the allegations from the Ukrainian officials. In addition, Cummins told Berman that Lutsenko had evidence that a ledger found in Ukraine in 2016 alleging to show payments to Manafort from a Russian-backed political party in Ukraine was doctored and the U.S. knew the evidence was corrupted. The emergence of the ledger caused Manafort to resign as Trump’s campaign chairman in August 2016, and eventually led to his conviction on money laundering and tax charges. “The second allegation above is that the Embassy and FBI willfully pressured Ukrainian officials to falsify evidence to be leaked to the media about Manafort to affect the outcome of the 2016 election,” Cummins wrote Berman.

Flashback: More Democrats than Republicans opposed Civil Rights Acts of 1964 and 1968

 

While significant Republican support helped the landmark Civil Rights Acts pass, Democratic Party support among minorities has continued to increase since the 1960s.

 

Looking back on the passage of the Civil Rights Acts of 1964 and 1968 after House Minority Leader Kevin McCarthy recently called on Democrats to rename their party over its ties to the Confederacy and segregation laws, it was Democrats in Congress who voted against those bills in larger numbers than Republicans. Some liberal commentators, such as Charles Blow of the New York Times, are calling for lawmakers in Congress to work together to craft a Civil Rights Act of 2020 after the death of George Floyd in the custody of Minneapolis police. The Civil Rights Acts of 1964 passed in the Democratic-led House 289-126 with 91 Democrats and 35 Republicans opposing it. The legislation passed in the Democratic-led Senate 73-27 with 21 Democrats and 6 Republicans in opposition. The bill included “injunctive relief against discrimination in public accommodation" and authorized the attorney general to "institute suits to protect constitutional rights in public facilities and public education, to extend the Commission on Civil Rights, to prevent discrimination in federally assisted programs.”

 

The Civil Rights Acts of 1968, which built on the civil rights legislation passed in 1964, passed in the Democratic-led House 327-93 with 67 Democrats opposing it and 25 Republicans in opposition. It passed in the Democratic-led Senate 71-20 with 17 Democrats and 3 Republicans opposed. The 1968 legislation “prohibited discrimination concerning the sale, rental and financing of housing based on race, religion, national origin or sex.” Both bills were signed into law by President Lyndon B. Johnson. While significant Republican support helped the landmark civil rights bills pass, Democratic Party support among minorities, particularly African-American voters, has continued to increase since the 1960s.

Cops Block Vandals From Taking Down Andrew Jackson Statue Near White House

 

Police on Monday dispersed a crowd of rioters who tried tear down a statue of former U.S. President Andrew Jackson near the White House. The rioters climbed onto the statue and tied ropes and cords around it before trying to pull the statue away from its base, videos posted to social media showed. Vandals also doused the marble pedestal with yellow paint. Police officers moved in with pepper spray to help move vandals and surrounding crowd away from the statue and disperse them out of Lafayette Square, WUSA-TV in Washington reported.

 

The incident took place around 8 p.m. Most of the crowd stayed in the Black Lives Matter Plaza after being pushed out of Lafayette Square, according to WUS9. The statue was erected in 1852 on a white marble base and depicts Jackson, the seventh President of the United States, on a rearing horse. It remains mounted on its pedestal. On the same night, a group of demonstrators reportedly tried to form a “Black House Autonomous Zone,” or “BHAZ” near the White House, in what appears to be an imitation of the self-proclaimed “Capitol Hill Autonomous Zone,” or CHAZ in Seattle—which has since been renamed to “Capitol Hill Occupied Protest,” or CHOP. A video posted by The Daily Caller shows St. John’s Episocal Church vandalized with spray paint with the acronym “BHAZ.” Police later secured a perimeter in front of the church.

 

Late Monday night, President Donald Trump announced on Twitter that “numerous people” have been arrested “for the disgraceful vandalism, in Lafayette Park, of the magnificent Statue of Andrew Jackson, in addition to the exterior defacing of St. John’s Church across the street.” Trump also warned that those who behave in violation of the Veteran’s Memorial Preservation Act can face 10 years in prison. Interior Secretary David Bernhardt, who was at the scene Monday night, issued a statement on Twitter praising law enforcement and denouncing the attempted act of desecration by “anarchists.” “I just left Lafayette Square where another so called ‘peaceful protest’ led to destruction tonight,” he wrote. “Let me be clear: we will not bow to anarchists. Law and order will prevail, and justice will be served.”

Museum of Natural History to Remove Roosevelt Statue

 

A statue of Theodore Roosevelt by the entrance to the American Museum of Natural History in New York City will be removed, the city announced on June 21. In a statement Sunday evening, New York City Mayor, Democrat Bill de Blasio, said the request to remove the bronze statue of the former president was made by the museum. The statue, which is owned by the city and has presided over the museum’s Central Park West entrance since 1940, depicts Roosevelt on horseback while flanked by a Native American man and an African man.

 

“The American Museum of Natural History has asked to remove the Theodore Roosevelt statue because it explicitly depicts Black and Indigenous people as subjugated and racially inferior,” de Blasio said in a statement. “The City supports the Museum’s request. It is the right decision and the right time to remove this problematic statue,” he said. The move follows waves of protests across the United States over the death of George Floyd on May 25 in Minneapolis. He died after a city police officer knelt on his neck for nearly eight minutes. Statues have been toppled and vandalized across multiple states, with opponents of Confederate memorials decrying them as an affront to African-Americans and the ideals of racial equality.

 

Supporters of keeping the statues meanwhile argue they represent an important part of history or that any actions to remove or move statues should go through a round of consultation. In a statement on its website, the Museum of Natural History said that the statue of the 26th president was unveiled to celebrate Roosevelt as a devoted naturalist and author of works on natural history. “Roosevelt’s father was one of the Museum’s founders, and the Museum is proud of its historic association with the Roosevelt family,” the museum said. “At the same time, the statue itself communicates a racial hierarchy that the Museum and members of the public have long found disturbing.” “Over the last few weeks, our museum community has been profoundly moved by the ever-widening movement for racial justice that has emerged after the killing of George Floyd,” the museum’s president, Ellen V. Futter, told The New York Times on Sunday. “We have watched as the attention of the world and the country has increasingly turned to statues as powerful and hurtful symbols of systemic racism,” she added of the museum’s view. “Simply put, the time has come to move it.”

 

The equestrian statue was previously vandalized in October 2017 by a group who identified themselves as members of the Monument Removal Brigade. They called for its removal as the statue could be seen an emblem of “patriarchy, white supremacy, and settler-colonialism.” It is not yet clear what will happen to the bronze statue or when it will be removed.
