correct. the court of appeal merely directs a trial judge to perform a certain act. Flynn is not truly dismissed unless and until Sullivan enters a judgment of dismissal.

 

I'm not sure what happens if Sullivan refuses to act; in all my years of working in a certain profession, I've never seen it happen.

Sullivan does not need to set a hearing. He just needs to sign an order and have the clerk enter a dismissal on the docket per the order.

Let's see how long he drags his oxfords on this. I'm sure he's getting calls already telling him to hold off as long as possible.

If he doesn't act soon, I'd petition to disqualify him and have another judge assigned to the case: just to dismiss it

great point. maybe Sullivan will set his robes on fire and refuse to obey the appellate writ of mandamus, requiring him to dismiss.

 

if Sullivan gets a "book deal" or a t.v. gig, who knows?

I think they're just about out of ammo re: Flynn. My guess is that MSM will ignore whatever he says after the gag is lifted and claim they're doing it to protect national security. Expect shills like Clapper to back them up.
