However, closing actions in the case narrows down the avenues that Judge Sullivan has any hope of reviving his bullshit to just one - an en banc re-hearing by the DC Circuit Court of Appeals. When that deadline passes in 29 more days, the mandate becomes final and that's that.

First, cone of elephant shit, as the other person who aptly responded to you pointed out, the Judge is the respondent in a petition for writ of mandamus, and as a result is a party to the matter.

 

Second, shitgrease plunger, the DC Circuit Court of Appeals can, by the request of any of its members, decide within 30 days to conduct a rehearing en banc on its own, with NO ONE requesting it. This is known as sua sponte action (on the court's own motion).
