I think the issue being raised is what speech is not protected by the 1st amendment. OW Holmes famous, "Fire in a crowded theater", analogy ( Schenck v. United States) addressed that he felt speech that was knowingly false was not protected.

Overall issue here is aiming at a SC review of using knowingly false statements to undermine an administration, IMO.
