As a lawfag, I can tell you:

First, the CFR (Code of Federal Regulations) cited here is an OSHA code that applies to employers and employees only by its language.

 

Second, Oregon may hav elected to interpret it as being applicable to all persons on a premises - states are not allowed to fall below the minimum standards set by Federal Regulations, but may exceed them.

 

Third, the majority of the State of Oregon is federally recognized as retarded enough to think that a regulation which includes provisions for Self-Contained Breathing Apparatus should be something requiring universal enforcement.
