PORTLAND — Acting Homeland Security Investigation (HSI) Special Agent in Charge Eben Roberts and U.S. Attorney Billy J. Williams announced today that seven people have been arrested and face federal charges for their roles in weekend riots at the Mark O. Hatfield U.S. Courthouse in Portland.

 

According to court documents, since May 26, 2020, protests in downtown Portland have regularly been followed by nightly criminal activity including assaults on law enforcement officers, destruction of property, looting, arson, and vandalism.

 

Rowan Olsen, 19, of Portland, is charged with disorderly conduct, creating a hazard on federal property, and failing to obey a lawful order; Shant Singh Ahuja, 28, of Oceanside, California, is charged with destruction of federal property; and Andrew Steven Faulkner, 24, of Beaverton, Oregon; Gretchen Margaret Blank, 29, of Seattle, Washington; Christopher Fellini, 31, of Portland; Cody Porter, 28, of Portland; and Taimane Jame Teo, 24, of Eugene, Oregon, are charged with assaulting federal officers.

 

The Hatfield Federal Courthouse has been a repeated target of vandalism, sustaining extensive damage. U.S. Marshals Service deputies and officers from the Federal Protective Service, HSI and U.S. Customs and Border Protection (CBP) working to protect the courthouse have been subjected to threats; aerial fireworks including mortars; high intensity lasers targeting officers’ eyes; thrown rocks, bottles, and balloons filled with paint from demonstrators while performing their duties.

 

On July 2-3, 2020, Olsen is accused of using his body to push on and hold a glass door at the Hatfield Courthouse closed, preventing officers from exiting the building and causing the door to shatter. With the door broken, a mortar firework entered the courthouse, detonating near the officers. The officers used shields and their bodies to block the open doorway for approximately six hours until demonstrators dispersed.

 

On July 4, 2020, Ahuja is accused of willfully destroying a closed-circuit video camera mounted on the exterior of the Hatfield Courthouse.

 

On July 5, 2020, Blank is accused of assaulting a federal officer with a shield while the officer was attempting to arrest another protestor.

 

On July 5-6, 2020, Faulkner, Fellini, Porter, and Teo are accused of assaulting federal officers with high intensity lasers. At the time of his arrest, Faulkner also possessed a sheathed machete.

 

All seven defendants made their first appearances in federal court on July 6, 2020 and were released pending trial.

EW YORK — Following an investigation by ICE’s Homeland Security Investigations (HSI) New York’s Cultural Property, Arts and Antiquities (CPAA) unit with assistance from U.S. Customs and Border Protection (CBP), Ashraf Omar Eldarir, a U.S. citizen, is being charged with smuggling Egyptian cultural property into the United States. Eldarir, 47, was previously arrested on a complaint filed by the U.S. Attorney’s Office for the Eastern District of New York (EDNY) in February 2020, after arriving at John F. Kennedy (JFK) International Airport with three suitcases filled with undeclared Egyptian antiquities.

“Eldarir’s alleged smuggling of nearly 590 artifacts pillaged from Egypt is yet another example of an individual seeking to profit by stealing history from another nation,” said Peter C. Fitzhugh, special agent in charge of HSI New York. “HSI New York continues to collaborate with our partners at CBP to stop the smuggling of illicit goods through the JFK airport and onto American soil.”

 

“These cultural treasures traveled across centuries and millennia, only to end up unceremoniously stuffed in a dirt-caked suitcase at JFK,” stated United States Attorney for EDNY, Richard P. Donoghue. “We commend our CBP and HSI partners for their excellent work and, with them, we stand ready to investigate and prosecute those who attempt to profit from the illegal smuggling of irreplaceable ancient artifacts.”

 

“U.S. Customs and Border Protection is extremely proud to have played an important role in the seizing of these Egyptian antiquities as this would be smuggler attempted to enter the country with his illegally obtained artifacts,” stated CPB Director of Field Operations Troy Miller. “CBP’s cooperation with HSI and the Eastern District of New York demonstrates the continuing resolve of law enforcement in the United States to address illegal trafficking in stolen artifacts.”

 

As set forth in court filings, on Jan. 22, 2020, Eldarir arrived at JFK from Egypt with three checked suitcases. Eldarir falsely declared to CBP that he was carrying goods valued at only $300 U.S. dollars. However, when CBP officers opened Eldarir’s suitcases they found approximately 590 bubble and foam-wrapped Egyptian antiquities. When the protective wrapping was opened, loose sand and dirt spilled out, and some of the items smelled of wet earth, indicators that the artifacts had been recently excavated. Among the items recovered by law enforcement officers are gold amulets from a funerary set; a relief with the cartouche of a Ptolemaic king that was, originally part of a royal building or temple; wooden tomb model figures with linen garments adhering dating to approximately 1900 BCE, and two complete Roman period funerary stelae of the type found at Kom abu Bellou in Egypt. Eldarir did not produce any of the required documentation from Egypt authorizing the export of the artifacts. Eldarir was charged with one count of smuggling arising from this incident and one count of smuggling involving an earlier trip in which he smuggled an ancient Egyptian polychrome relief.

 

The charges in the indictment are allegations, and the defendant is presumed innocent unless and until proven guilty. If convicted, Eldarir faces a maximum sentence of 20 years’ imprisonment on each count. The government’s case is being handled by the EDNY’s General Crimes Section. EDNY’s Civil Division is handling forfeiture matters.

BALTIMORE – A man arrested for sexual abuse of a minor was released from police custody in Montgomery County, Maryland, June 23, despite a request from U.S. Immigration and Customs Enforcement (ICE) Enforcement and Removal Operations (ERO) officers to hold him so he could be arrested also for violating U.S. immigration laws.

 

ERO officers had lodged a detainer June 19 with Montgomery County Detention Center on Rene Atilio Ramos-Hernandez, 56, an unlawfully present citizen of El Salvador and a convicted criminal alien, following his recent arrest for sexual abuse of a minor. The detainer was not honored, and Ramos-Hernandez was released back into the community June 23. Officers at Montgomery County Detention Center called to notify the ERO Baltimore field office as he was being released but refused to hold Ramos-Hernandez for the time required for ERO officers to travel to the facility.

“Montgomery County continues the practice of not honoring lawful ICE detainers and release potential public safety threats back into the community,” said acting Baltimore Field Office Director Francisco Madrigal. “When they refuse to give adequate notification of an impending release to allow a safe transfer of custody, it shows their actions are insincere. ICE believes the best way to protect public safety is for law enforcement to work together.”

About Detainers

 

Under federal law, ICE has the authority to lodge immigration detainers with law enforcement partners who have custody of individuals arrested on criminal charges and who ICE has probable cause to believe are removable aliens. The detainer form asks the other law enforcement agency to notify ICE in advance of release and to maintain custody of the alien for a brief period of time so that ICE can take custody of that person in a safe and secure setting upon release from that agency’s custody. Yet, across the United States, several jurisdictions refuse to honor detainers and instead choose to willingly release criminal offenders back into their local communities where they are free to offend.

 

Congress has established no process, requirement, or expectation directing ICE to seek a judicial warrant from already overburdened federal courts before taking custody of an alien on civil immigration violations. This idea is simply a figment created by those who wish to undermine immigration enforcement and excuse the ill-conceived practices of sanctuary jurisdictions that put politics before public safety.

Sanctuary Policies Put Public Safety at Risk

 

When law enforcement agencies fail to honor immigration detainers and release a criminal alien onto the streets, it negatively impacts public safety. Any local jurisdiction thinking that refusing to cooperate with ICE will result in a decrease in local immigration enforcement is mistaken. Local jurisdictions that choose to not cooperate with ICE are likely to see an increase in ICE enforcement activity, as the agency has no choice but to conduct more at-large arrest operations. A consequence of ICE being forced to make more arrests on the streets, the agency is likely to encounter other unlawfully present foreign nationals who would not have been encountered had we been allowed to take custody of a criminal target within the confines of a local jail. Additionally, once these criminals are out on the street, confirming their whereabouts is often time consuming and resource intensive. Many of our arrest targets are seasoned criminals who are savvy about eluding law enforcement.

While conducting a targeted enforcement action in Port Chester, New York, ERO deportation officers assigned to ERO-New York’s Newburgh Sub-Office arrested 36-year-old Cherlle Francisco Das Neves, a convicted criminal alien who has pending criminal charges.

 

Das Neves, who illegally entered the U.S. at an undetermined time and location, also has a conviction in 2014 for disorderly conduct.

 

On Dec. 13, 2019, the Village of Port Chester Police Department arrested and charged Das Neves with third-degree assault with intent to cause serious physical injury; acts in a manner injurious to a child less than 17 years old; and criminal mischief with intent to damage property.

 

On Dec.17, 2019, ERO deportation officers lodged a detainer with the Westchester County Department of Corrections (WCDC). However, the detainer was not honored and Das Neves was released back into the community by the WCDC, without notifying ICE.

 

Westchester County’s Immigrant Protection Act enabled the release of Das Neves, a violent criminal, because the county’s law, passed in 2018, bars its law enforcement agencies from assisting federal agencies, such as ICE, in conducting investigations into undocumented aliens.

“I’m sure the concerned citizens of Westchester County have questions about why their local government passed a law that protects the criminal alien over their safety and forces their police department to release this violent criminal – with pending criminal charges – back into their community,” said Thomas R. Decker, ERO New York’s field office director. “What local politicians should realize is that failing to honor detainers may create additional challenges for ICE to arrest and remove criminals like Das Neves. But more importantly, failing to honor the detainers ultimately makes our communities less safe because these criminals are released back into the same streets to continue to commit violent crimes against the public. Thankfully, NYC ERO Officers are protecting the community and Das Neves will remain in ICE custody pending a hearing before an immigration judge."

AN DIEGO - U.S. Customs and Border Protection officers working at the Otay Mesa port of entry Monday found more than 139 pounds of liquid methamphetamine and two pounds of heroin in the gas tank and spare tire of a vehicle.

 

Officers searched the vehicle; they discovered and extracted 131 packages of methamphetamine and heroin from the gas tank and spare tire. On July 6, at about 4:30 a.m., CBP officers encountered a 52-year-old woman driving a GMC Safari with a 71-year-old female passenger when they entered the Otay Mesa border crossing. A CBP officer and his canine were roving the area and the detector dog alerted to the undercarriage.

 

Officers escorted the vehicle and occupants to a secure location for inspection. They ran the vehicle through the ports imaging system, which revealed anomalies within the vehicle. Officers then searched the vehicle; they discovered and extracted 131 packages of methamphetamine and heroin from the gas tank and spare tire.

 

The driver, a citizen of Mexico and lawful permanent resident of the U.S., was turned over to agents with Homeland Security Investigations. The female passenger, also a citizen of Mexico and lawful permanent resident, was released.

YUMA, Ariz. – Yuma Sector Border Patrol agents thwarted multiple smuggling events and apprehended 21 illegal aliens over a four-day period.

 

In the first event on Thursday, Blythe Station agents performed a vehicle stop on a white Chevrolet Silverado and white Dodge Ram in Quartzsite. The driver of both vehicles were United States citizens and the four passengers in the Silverado and three passengers in the Ram were illegal aliens. The drivers of both vehicles were arrested for human smuggling violations and the illegal aliens were processed for immigration violations.

 

In the second event on Friday, Wellton Station agents encountered a white Ford Club Wagon agricultural van at the immigration checkpoint on Interstate 8. Agents performed an immigration inspection on all individuals and determined that three backseat passengers were illegal aliens. The illegal aliens were processed for immigration violations.

 

In the third event on Sunday, Blythe Station agents performed a vehicle stop on a gold Infinity I30 traveling on I-10. Agents determined that the driver was a U.S. citizen and the three passengers were illegal aliens. The driver was arrested for human smuggling violations and the illegal aliens were processed for immigration violations.

 

In the final event on Monday, Wellton Station agents performed a vehicle stop on a white Ford E-350 in the Dome Valley area. Agents observed several individuals laying down in the cargo area and determined that eight of the nine subjects were illegal aliens. The driver, a U.S. citizen, was arrested for human smuggling violations and the illegal aliens were processed for immigration violations.

Autonomous surveillance towers, known formerly as Innovative Towers, operate off-grid with 100 percent renewable energy and provide autonomous surveillance operations 24 hours per day, 365 days per year.

 

Perfectly suited for remote and rural locations, the AST scans the environment with radar to detect movement, orients a camera to the location of the movement detected by the radar, and analyzes the imagery using algorithms to autonomously identify items of interest, such as people or vehicles. Border Patrol agents are then alerted to this event and have the opportunity to make the final determination on what the item is and if it poses a threat.Autonomous Surveillance Tower

 

These innovative towers operate completely off grid using 100 percent renewable energy, have a small geographic footprint, and minimize the impact to land owners and public lands to the maximum extent. “These towers give agents in the field a significant leg up against the criminal networks that facilitate illegal cross-border activity,” said Border Patrol Chief Rodney Scott. “The more our agents know about what they encounter in the field, the more safely and effectively they can respond.”

 

AST SensorsCBP first piloted the towers in early 2018 with four towers in the San Diego Border Patrol Sector, and has since procured 56 additional towers. CBP is on a path to procure and deploy 140 additional towers in Fiscal Years 2021 and 2022, to reach a total of 200 towers.

 

Autonomous technology is a true force multiplier for CBP, enabling Border Patrol agents to remain focused on their interdiction mission rather than operating surveillance systems. Investments in autonomous operation, artificial intelligence, and other advanced technologies native to the Autonomous Surveillance Towers are absolutely essential to border security and compliment other capabilities such as the Border Wall System, Remote Video Surveillance System, Integrated Fixed Towers, Mobile Surveillance and small drones.
