So if a gang shoots up your town, vouch for each other that they didn't do it, and you can not prove that any individual is to blame, you suggest we do nothing?

So is the plan that Trump loses and then they make arrests after the election before Biden is inaugurated?

It is very apparent to me that the 'rule of law' is just political cover for the political elite to do what the feel is acceptable within their group, and the current crop is just more of the same and they don't trust Trump actually has the power to win a second term. They don't want to get caught on the 'wrong side of history' should Biden win. And if Trump wins again, they will drag it out more for the same reason because a Pence presidency would be about as likely as hell freezing over. The favorite tactic of these people: Cover Your Ass.

That is exactly what is the Achilles heal of our system. There is the assumption that we are not in a war with a group that has infiltrated our system. The rules of war are significantly different than the rules of a justice system. Justice systems only work in civil societies and the rule of law for most of the people alive today has only worked among the elites. When the enemy's entire goal is to break civil society, judging them by civil society rules is problematic.
