The Trump administration plans to make an announcement next week related to escalating tensions in the South China Sea, where Washington and Beijing are vying for military supremacy, according to two people familiar with the matter.

 

The U.S. has raised concerns over China’s decision to conduct military exercises in the contested waters around the Paracel Islands. The Defense Department last week called the actions “unlawful,” and the U.S. plans to lay out its official position next week, said one of the people who spoke on condition of anonymity.

 

The unspecified move comes as President Donald Trump has intensified his criticism of Beijing over issues from the coronavirus pandemic to trade. A spokesperson for the National Security Council didn’t immediately respond to a request for comment.

Ever since the Supreme Court released its decision in South Dakota v. Wayfair on June 21, 2018, we have been flooded with questions about economic nexus legislation and how it affects businesses across the country. Below you will find most common questions we’ve received. We will be regularly updating this page as more questions come in.

 

Many of the questions focus on the details of South Dakota’s economic nexus legislation, as upheld by the Supreme Court. For reference, as you work through this page, this is what the legislation says:

 

A retailer would be presumed to be liable for the collection of sales and use tax in South Dakota, even if the seller does not have a physical presence in state, if the seller meets either of the following criteria in the previous or current calendar year:

 

The seller’s gross revenue from the sale of tangible personal property, any product transferred electronically, or services delivered into South Dakota exceeds $100,000; or

The seller sold tangible personal property, any product transferred electronically, or services for delivery into South Dakota in 200 or more separate transactions.

On June 21, 2018, the U.S. Supreme Court issued its decision in the South Dakota v. Wayfair case, which revolved around South Dakota’s economic nexus legislation that was enacted in 2016. In a 5-4 decision, the Supreme Court ruled in favor of South Dakota and overruled Quill Corp. v. North Dakota and National Bellas Hess, Inc. v. Department of Revenue of Ill. The Court concluded that “the physical presence rule of Quill is unsound and incorrect.”

 

Writing for the majority, Justice Kennedy delivered the opinion of the Court. He wrote, “First, the physical presence rule is not a necessary interpretation of Complete Auto’s nexus requirement.” He continued, “Second, Quill creates rather than resolves market distortions” and “Third, Quill imposes the sort of arbitrary, formalistic distinction that the Court’s modern Commerce Clause precedents disavow in favor of ‘a sensitive, case-by-case analysis of purposes and effects.’” The Court concluded that “…a business need not have a physical presence in a State to satisfy the demands of due process.”

The Boston-based company became one of the biggest online purveyors of home goods in the U.S. practically overnight, with sales exploding to $916 million last year from $601 million in 2012.

 

Wayfair's massive growth comes more than a decade after its founding, when it was called CSN Stores and sold speaker and television stands on the website RacksAndStands.com.

 

Wayfair CEO Niraj Shah founded CSN with his Cornell classmate Steve Conine, in 2002. The generic name was chosen to avoid scaring off manufacturers who were burned by the dot-com crash, Shah said.
