As a NON-lawyer, I can tell you that the entire transaction is illegal as all hell … but the medium of exchange is irrelevant if both buyer and seller are in agreement.

The most the CC issuer will do is contact the buyer if the size of the purchase trips a fraud trigger. If the card holder says "Yep … I meant to do that." the sale will be processed. The issuer never sees the kid, they only "see" the invoice.
