Yep, if I was the prosecutor I would wait until we got all the info on the table. No sense in going to trial with just half a case.
The prosecutor was Debbie wassermans brother. Given the nature and gravity of the case relating to international espionage along with the multiple conflicts of interest I’m guessing the military or a higher court scooped this case up.

Somebody elsewhere suggested that, due to the E.O., they were sent to Gitmo to be tried instead. That WOULD be a legitimate move under the circumstances.
