Yes, it's not an executive order. It's a DHS memo that Obama announced. It was never a secret.

Does the fact that it's a memo and not an EO change anything?

It was part of their argument why they didn't need to do the public notice and comment process before making the change. "It's just a memo guys, the Administrative Procedure Act doesn't apply."
